Niehaus, Assistant to the Village Manager Water Tower Lease to Nextel& Cellular One The Committee discussed with industry representatives the proposed 9-1-1 lease language. It was noted that the Village is seeking the leasee's cooperation in two areas: 1. Working with the Public Safety agencies to develop a State law agreeable to both parties; and, 2. Working with AT&T Wireless to obtain their cooperation in developing agreeable language. Both Nextel and Cellular One provided letters (attached) indicating their support of the proposed State law for 9-1-1 surcharge funding. In addition, both companies contacted AT&T. AT&T is now working with the public safety group in Springfield to develop agreeable language for the State law. The Village Attorney indicated that, if the State Law does not pass, the Village can still enact a 9-1-1 surcharge ordinance upon wireless carriers. Our ordinance will carry the weight of law upon all carriers doing business in the Village. The Village does not need to have the provision in our lease with Nextel and Cellular One to implement the ordinance. In addition, the Committee discussed the placement of a red light on top of the water tower for helicopter visibility purposes. Both Nextel and Cellular One agreed to pay for the installation of a light on top of the tower. Staff will ascertain if the red light can be installed without voiding the warranty on the tower or causing any other adverse concerns. After further deliberation, the consensus of the JPZ Committee was to recommend that the Village Board adopt the proposed leases for Nextel and Cellular One without the 9-1-1 language so they may utilize the west side water tower. In addition, it was the consensus to include a provision in the Special Use Permit requiring Nextel and Cellular One to install a red aircraft light on top of the water tower upon the request of the Village. Taxicab Licensing Regulations The Village Attorney advised the JPZ Committee of additional information which was ascertained subsequent to their Public Hearing. After a review of the additional information, it was the consensus of the Committee to recommend the following action to the Village Board: • Increase the licensing fee to $500 for the dispatcher's license and leave the other license fees at their current level; • Request the Public Vehicle Commission(Village Board) to hold a hearing on the fare increase request by American Taxi Cab Company and discuss the Village's dispatcher license fee increase at said hearing; • Reconvene the Public Vehicle Commission and recommend denying the additional dispatcher license requests made in 1997 as there is no apparent need for additional licenses nor is there any complaints about the service of the existing licensees; and, • Do not implement any amendments to the licensing provisions. Massage Ordinance The Committee reviewed the draft Ordinance prepared by the Village Attorney. There were some additions and amendments suggested by the Committee members. Mr. Len Pinkowski, a Massage Therapist, offered his comments on the draft Ordinance in terms of its effect upon practicing therapists. The Committee requested the Village Attorney to prepare a second draft Ordinance with various changes as suggested by the Committee members. Johnson and the Village Board of Trustees Elk Grove Village 901 Wellington Avenue Elk Grove Village,Illinois 60007 Dear President Johnson and Members of the Village Board: During the Judicial, Planning, and Zoning Committee meeting held in December of 1997, members of the Village Board and staff expressed concern regarding their belief that wireless companies are opposed to statewide 9-1-1 legislation. Subsequently President Johnson sent a letter to Mr. Christopher Dunn of AT&T Wireless Services regarding this matter. This letter was copied to all participants of the December JPZ Committee meeting and sought the wireless industry's support for passage of statewide wireless 9-1-1 legislation. As a nationwide provider of wireless telecommunications services,Nextel Communications, Inc. has worked diligently to ensure its customers have access to emergency services. Nextel actively participated in the Federal Communications Commission's rule making proceeding regarding wireless 9-1-1 services. Nextel has worked with other wireless carriers in Illinois as well as numerous other states to develop statewide wireless 9-1-1 legislation necessary to ensure that wireless telecommunications users can reach emergency services where available. Thus, at the request of Elk Grove Village and in an effort to further Nextel's objectives for providing its customers 9-1-1 service, Nextel has actively supported the passage of wireless 9-1-1 legislation by directing its lobbyists in Springfield to work with other carriers and public safety representatives on agreeable language. Nextel will continue to work with other wireless carriers and the public safety community until such legislation is passed by the Illinois General Assembly and signed into law. Wellington Ave. Elk Grove Village, IL 60007 Dear Mr. Johnson: This letter is to clarify for you the position of Cellular One in regard to the passage of meaningful wireless 911 legislation in Illinois. Because emergency services are of the utmost importance to our customers, Southwestern Bell Mobile Systems/Cellular One and its affiliates have been continuing to work together with the public safety community to try to pass legislation for wireless 911 services in Illinois. Specifically, Cellular One has worked with the Illinois Chapter of the National Emergency Numbering Association, as well as with other carriers on the draft of House Bill #646. We are optimistic that mutually agreed upon legislation for statewide wireless 911 services will be passed in the fall veto session and we will continue to work to achieve that goal. As would an Emergency Telephone Service Bureau, Cellular One prefers a statutory resolution of funding and liability issues as soon as possible. We appreciate any frustration that Elk Grove Village has experienced in regard to the lack of such legislation.
