VILLAGE CLERK 5 UrFICE JPZ Members Present: Bart Dill, Village Trustee, Chairperson Nancy Czarnick, Village Trustee Sam Lissner, Village Trustee Staff Present: Alan Boffice, Director, E & CD Steve Trudan, Asst. Director, CD Residential Tear Down Regulations The meeting was called to order at 7:05 P.M. Trustee Dill asked for staff to evaluate whether or not the Village has adequate safeguards in place to avoid the problems associated with residential tear downs. Mr. Boyce explained that older communities were experiencing problems resulting from homes being built many years ago with minimal restrictions. Zoning regulations often consisted of nothing more than minimum setback requirements. The most common problem resulting from these antiquated regulations is the replacement of old homes with bigger homes that do not fit into the existing neighborhoods with respect to size or architectural style. Mr. Boffice further explained that Elk Grove does not experience these problems since the Village is relatively young, and, more importantly, our zoning regulations include such restrictions as maximum ground coverage, maximum floor area ratio, maximum allowable height of structures and other bulk regulations. These standards have been consistent throughout the years and will provide adequate protection from the problems that typically arise as a result of tear downs. Trustee Dill asked what happens with developed properties that are annexed into the Village which do not meet our standards. Mr. Boffice explained that they would be brought in with a legal non-conforming status, and any future improvements and or replacement of the homes would be regulated by our standards. Page 2 Trustee Czarnick asked if a non-conforming tear down would also require removal of the foundation. Mr. Boffice explained that it would. He further explained that the lots as well as the structures would be required to be brought into compliance with our subdivision control ordinance and the minimum bulk requirements for individual lots. Trustee Lissner asked if someone could tear down two homes and replace them with one larger home. Mr. Boffice explained that our Zoning Ordinance would allow one structure on one lot and added that the subdivision process would have to be followed which requires approval by the Village Board. Mr. Boffice concluded that since almost all of our single family residential properties are located within the R-3 district they have all been regulated by a single set of standards. This combined with the fact that our regulations have been comprehensive and consistent from day one leads us to conclude that no new legislation will be required to prevent problems commonly associated with residential tear downs. The concensus of the committee was to endorse this conclusion. Parking in Commercial Areas Mr. Boffice began this segment of the meeting by stating that the current regulations which require a minimum number of parking spaces for retail and medical center uses are too restrictive. He cited Gullo Shopping center as an example of those restrictions needlessly requiring variations to allow full occupancy of the buildings. He concluded that as a result of practical observations and comparisons with the regulations of six neighboring communities, the Village should act as petitioner to propose a text amendment that would (a) change the retail parking ratio from one space for each 180 square feet of floor area to one space for each 200 square feet of floor area, (b) change the medical center parking ratio from one space for each 125 square feet of floor area to one space for each 150 square feet of floor area, and (c) establish a "land bank"option for required parking. The land bank option would allow a developer to construct a reduced amount of parking as long as an area is reserved on-site for the construction of the full amount of parking, if it is determined that there is a need to do so at a future date. Page 3 After some further discussion it was the consensus of the Committee to recommend that the text amendments be sought as proposed by staff. Adjournment The meeting adjourned at 7:40 P.M.
