Director, CD REGULATIONS FOR BOATS AND RV'S Chairman Dill called the meeting to order and explained that he would be making a proposal to the committee. He further explained that the night's proceedings would be unlike the previous two meetings in that there would be no interaction with the audience since the fact-finding segment of the process had been concluded. Chairman Dill stated that as a result of surveys, research, and input from residents he felt there was a need to introduce some restrictions designed to control the parking and storage of large boats and RV's. Without such regulations, anyone is permitted to park and store absolutely anything on their residential lot irrespective of size or weight. He added that he believes that there are some vehicles that are overwhelming because of their size, and are out of place in the residential areas. Chairman Dill then stated that it was not intended to proposed regulations which would disallow the parking of commercial vehicles, pop-up type campers on a single axle, small boats on single axle trailers, automobiles, minivans, SUV's and pickup trucks. He concluded his opening statement by proposing the following: 1. That the parking and storage of oversized motorized recreational vehicles be prohibited outdoors within the residentially zoned districts. Such motorized recreational vehicles may be temporarily parked on an approved paved surface in the front yard within the residential area for a period not to exceed 72 hours for the purpose of loading, unloading, cleaning and maintenance. 2. That tow-type vehicles and boats be permitted outdoors, however are subject to the following conditions: a. Such vehicles are limited to a single axle design. b. The overall length of the vehicle, including the tongue of the trailer and the furthermost projection of the trailer and vehicle being towed, not exceed a length of twenty-five feet (25). The overall height shall not exceed eight feet (8) and the overall width shall not exceed nine feet (9). c. That no portion of any such vehicle be permitted to overhang or block the public sidewalk. Trustee Lissner asked if the proposed regulations would also regulate commercial vehicles. Chairman Dill explained that they would not. Trustee Czarnik asked why the trailers were limited to a single axle. Mr. Boffice explained that there was a correlation between the number of axles and the size of the vehicle being towed. Mr. Boffice also explained that the proposed length limit of twenty-five feet correlates with the standard front yard setback as well as a standard driveway length throughout the Village. Trustee Czarnik asked how the 72 hour loading allowance would be enforced and asked for clarification of the proposal to prohibit the blocking of the public sidewalk. Mr. Boffice stated that the 72-hour loading allowance would really fall into what he called an honor system that would be enforced on a complaint basis. He also explained that the concept of parking a vehicle that is being used on a daily basis differs from storing a vehicle that is not moved for extended periods of time with respect to the effect each has on the neighborhood. Mr. Knickerbocker explained that it would be possible for someone to request a variation if a hardship could be demonstrated. Trustee Lissner asked if permits would be issued for permitted vehicles. Mr. Boffice explained that he did not feel permits would be necessary since all existing and new vehicles would be subject to the same regulations. Trustee Lissner asked if the Zoning Ordinance had regulations that dealt with obstruction to vision. Mr. Boffice explained the sight line triangles that were defined and regulated at the intersections of driveways and sidewalks. Chairman Dill stated that he received a complaint from a resident who said his neighbor was storing an RV for someone that did not reside in that home. Trustee Czarnik stated that over the years she received many comments from residents that were both for and against allowing boats and RV's on residential driveways. She added that she also received a complaint that someone was storing a boat for someone else. Mr. Boffice pointed out that there were several subdivisions within the Village that had associations that prohibited outdoor parking of any boats or RV's. Trustee Lissner stated that he felt that commercial vehicles should also be required to meet the proposed size limitations. Mr. Boffice stated that commercial vehicles were not part of the surveys or studies obtained for the purpose of the proceedings and emphasized that there is a difference between vehicles being parked versus stored. Trustee Lissner stated that all vehicles not meeting the proposed size limitations should be prohibited. Mr. Knickerbocker stated that some communities also limit the number of boats and RV's even when they meet the size limitations. Chairman Dill asked what the consensus of the committee would be. Trustee Lissner stated that he felt all vehicles should be required to meet the proposed criteria. Trustee Czarnik stated that the Committee should recommend the proposed regulations pertaining to boats and RV's only and that further research should be done regarding commercial vehicles for consideration at a later date. By a two to one vote (Chairman Dill and Trustee Lissner ayes, Trustee Czarnik nay), the Committee reached a decision to recommend to the Mayor and Board of Trustees that the Village adopt the restrictions proposed to regulate boats and RV's, but to include vehicles of all types to be so regulated, not just boats and RV's. The meeting was adjourned at 8:00 P.M. C: Mayor and Board of Trustees, Plan Commission Chairman, Village Clerk, Village Manager, Assistant Village Manager, Assistant to the Village Manager, Director of Engineering & Community Development, Village Attorney May, '04 REGULATION OF OVERSIZED RECREATIONAL VEHICLES As a result of the March 1, 2004 survey of the types of oversized recreational vehicles and boats that are currently parked within the Village, and the Northwest Municipal Conference Survey that identified the manner in which other communities regulate those types of vehicles, I believe that there is a need for the regulation of large motor homes, large boats and large non-motorized trailers within Elk Grove Village. My belief is based upon the probable reality that without such regulations, anyone is permitted to park and store absolutely anything on their residential lot, irrespective of size or weight. 1 further believe that there are some vehicles, which are overwhelming because of their size, and are out of place in the residential areas. It is not intended to propose regulations which would disallow the parking of commercial vehicles, pop-up type campers on a single axle, small boats on single axle trailers, automobiles, minivans, SUVs and pickup trucks. Included, are small travel trailers on single axles, small non-motorized single axle trailers and garbage dumpsters when associated with construction activities. On the other hand, I feel duty bound to propose the regulation of oversized motor homes, boats, and large work and transportation trailers that are inconsistent with the stated purposes of the Village's zoning regulations which insure that: • Adequate light, clean air and safety from fire and other dangers may be secured. • The taxable value of land and buildings throughout the municipality may be preserved. • The public health, safety, comfort, and welfare may otherwise be promoted. Towards those ends, the following is proposed: 1. That the parking and storage of oversized motorized recreational vehicles be prohibited outdoors within the residentially zoned districts.
