Dir., CD George Knickerbocker, Village Attorney Mike Cavallini, Director, Health/CS LICENSING OF SINGLE FAMILY RENTAL PROPERTIES The Committee had previously considered this topic and concluded that rental properties were adequately maintained and regulated according to existing codes and ordinances. The Chairman explained his reason for revisiting the topic was based on his concern that we should be able to identify owners and or tenants of rental properties in the event that one or both need to be contacted. Mr. Boffice explained that the Village currently has an accounting of the owners of rental properties which is obtained through the water billing applications filed in the Department of Finance. He added that the Village inspects the exterior of all rental properties on an annual basis and that tenants are advised that interior inspections can be accommodated upon request. Mr. Knickerbocker stated that it had previously been determined that the Village could incur unwanted liability if the issuance of licenses were tied to complete inspections on rental properties by Village personnel. Trustee Lissner emphasized again that his concern was not related to the maintenance of rental properties but to the Village's ability to identify owners and tenants. Trustee Prochno asked the Committee if they were attempting to solve a specific problem and added that if not, there would be no reason to impose additional responsibilities on the inspectors and the Department of Engineering and Community Development. Page 2 Discussion continued that included consideration of implementing fees for the licensing of rental properties. It was suggested that the property owners would be responsible for the ,payment of fees. It was the recommendation of the Committee that the Village look into the situation from the standpoint of creating a policy that would more effectively capture as much information as possible about rental properties. It was further suggested that the matter be revisited by the Committee before Spring 2006. MOTORCYCLES PARKED ON PORCHES The Committee noted that this topic was being discussed as a result of a resident complaint. After a brief discussion it was concluded that the complaint was an isolated incident and that there were no other known instances of motorcycles being parked on porches. The Committee and staff agreed that this type of situation could be adequately controlled through existing nuisance and fire prevention related ordinances. MORATORIUM ON THE CONSTRUCTION OF NEW BANKS Mr. Boffice explained the extent to which current zoning regulations control banks. He presented a map of the Village that showed the location of all existing banks and explained that freestanding buildings with drive-thru facilities require either B-3 zoning, or B-2 zoning with a special use permit. He added that there are currently no vacant B-3 parcels in the Village. The Committee discussed several methods which could be implemented to permit a more detailed assessment by the Village for any future bank developments. It was suggested that banks be evaluated through the special use process with emphasis being placed on demonstrating the .need for additional banking facilities. The consensus of the Committee was to further investigate the topic and to obtain information on how the Village of Buffalo Grove concluded their investigation into this issue. SMOKING ORDINANCE The Health & Community Services Director will provide the JPZ Committee with information on smoking ordinances from surrounding communities, a SWANCC survey of member municipalities pertaining to smoking ordinances in their communities, and the current smoking regulations enforced by the Village (Illinois Clean Indoor Air Act). Page 3 The Director reported that the Board of Health formed an ad hoc committee to review the health aspects of a smoking ordinance. It was the consensus of the JPZ Committee to meet in January with this ad hoc committee to discuss the various options of a smoking ordinance.
