HomeMy WebLinkAboutORDINANCE - 3481 - 2/14/2017 - Audio Recordings ORDINANCE NO. 3481 AN ORDINANCE OF THE VILLAGE OF ELK GROVE VILLAGE,ILLINOIS AUTHORIZING THE DESTRUCTION OF AUDIO RECORDINGS OF CLOSED MEETING SESSIONS WHEREAS,the Village of Elk Grove Village, Cook and DuPage Counties, Illinois is a home rule municipality as described in Section § 6(a)Article VII of the 1970 Constitution of the State of Illinois and as such may exercise any power and function pertaining to its government and affairs; and WHEREAS,the Illinois Open Meetings Act requires governmental bodies to audio or video record their closed meetings; and WHEREAS,the Illinois Open Meetings Act(5 ILCS 120/2.06 (c)) sets forth prerequisites to the destruction of verbatim closed session records; and WHEREAS,the Mayor and Board of Trustees deems it appropriate to destroy verbatim closed session records according to the requirements of 5 ILCS 120/2.06 (c) as amended from time to time. NOW,THEREFORE,BE IT ORDAINED by the Mayor and Board of Trustees of the Village of Elk Grove Village, Cook and DuPage Counties of Illinois, as follows: Section 1: That the Village Clerk is hereby authorized and shall destroy verbatim recordings of Closed Session Meetings from time to time, without further Village Board action, but only in the event that destruction occurs: (a) Not less than eighteen(18)months after the Closed Session meeting; and (b) With the consent of the Village Attorney; and (c) Only after the Mayor and Board of Trustees have approved the Minutes of the Closed Session, which Minutes include, at a minimum: (i) The date, time and place of the meeting; (ii) The members of the public body recorded as either present or absent; (iii) A summary of the discussion of all matters proposed, deliberated, or decided; and a record of any votes taken. Section 2: In the event that Minutes of a Closed Session meeting have not been distributed within the eighteen(18) month time frame set forth in 5 ILCS 120/2.06 (c), as amended from time to time,the Village Clerk shall so advise the Village Manager and not destroy the verbatim recordings. Upon subsequent distribution of the Minutes of the Closed Session the Village Clerk shall proceed to destroy the verbatim recordings without further action or approvals from the Mayor and Board of Trustees. Section 3: That this ordinance shall be in full force and effect from and after its passage and approval according to law. VOTE: AYES: 6 NAYS: 0 ABSENT: 0 PASSED this 14' day of February 2017.
