HomeMy WebLinkAboutCAPITAL IMPROVEMENTS - 05/06/1980 - Minutes Capital Improvements Committee May 6, 1980 The meeting of the Capital Improvements Committee was called to order by Chairman Tosto at 7:15 p.m. on Tuesday May 6, 1980, in the trustee's conference room. Members Present: Staff Present: Tosto, Michael A. , Chr. H. Peter Kaleta, Director of Public Works Garr, Lee D. Jack Andrews , Supt. of Street & Veh. Maint. Hauser, Edward R. The purpose of the meeting was to discuss the 1980 Elk Grove Village Street Program. A report was submitted to the Committee on April 22, 1980 for their review and consideration. After reviewing the report, it was the consensus of the committee to improve the streets as out- lined in the report. Attached to the minutes is a copy of the proposed streets which will be resurfaced or slurry sealed. As part of this program, a considerable portion, approximately $30,000 was to be used for milling of streets where the asphalt is presently above the curb gutter line. It was the recommendation of Trustee Tosto to postpone milling at this time and to use the same process that we used in the 1978 program in which the asphalt was taken to the face of the curb instead of stopping at the edge. There was considerable discussion as to the effect of taking the asphalt to the face of the curb in that over a period of years this asphalt would tend to pop out from underneath the concrete curb since the materials are of dis-similar type and would eventually result in a sharp drop off of the asphalt on to the gutter line, which is precisely what we are attempting to eliminate. The Committee decided to review the streets that were done in 1978, and see how much of the asphalt was still in place. The Committee will meet on Monday 12, at 6:30 p.m. to review those streets that were resurfaced in 1978 (see attached list of streets) to see the impact of placing the asphalt up to the curb face. Chairman Tosto, also recommended that a review be done to determine the econimics of purchasing a milling machine versus cost per foot contracting the milling work that is necessary. It is the chairman's contention that milling is the more acceptable method of resolving the problem of the high asphalt build up at the gutter line, however, the problem of the high asphalt will continue to grow over the years and that it would become more economical in the future to own and operate a milling machine by the Village than to have the work done on a cost of per lineal foot basis. Staff will prepare a cost analysis and report back to the committee for future considera- tions. It was also the chairman's recommendation that the $30,000 proposed for milling be used instead to replace worn or damaged sidewalks and curbs in the industrial area. In discussing the replacement of f Capital Imrpovements Committee Meeting May 6, 1980 of the curbs and sidewalks in the Industrial Park area, it was brought to the attention of the committee that a large number, possibly 200 to 300 locations within the Industrial area where the barrier curb has been removed and replaced with a depressed curb for loading dock areas or driveway areas. This curb has totally disintegrated .or is falling apart and in turn is causing damage to the Village asphalt pavement. Staff was directed to discuss the matter with the Village Attorney to determine if the responsibility for the replacement of this curb is the Village's or the individual property owner. It would appear that this portion of the curb in front of the drive- way apron could be considered the same as the extention of the driveway apron since it is solely used by the property owner and should be the responsibility of the property owner to maintain and repair. The issue is being reviewed by the attorney. Prepared by H. Village Manager SUBJECT: stal at ion of P lic Improvements During our previous dis ussions on Biesterfield Road, it was noted that many annexation agreements require the construction of certain improvements, particularly roadways, but often the agreements are silent on completion dates. n An example of a problem which may occur because of no completion date is the extension of Biesterfield Road through Parkview Heights Subdivision (Szywala) . The parcel was annexed in December 1977 with no annexation Vi provision for the completion of Biesterfield Road. Although the binder coarse is in place , it may be many years before the surface coarse is installed due to the housing industry slow-down. The surface coarse must be �q in place before the roadway is opened for through traffic . Q While the above is merely an example , which could be applied also to Roundtree Commons, I requested the Village Attorney to review the attached language to determine whether the Village could include such a provision in the existing Subdivision Control Ordinance and in future annexation agreements. I was advised by the Village Attorney that the attached language would be acceptable in future annexation agreements due to the greater flexibility and negotiation the Village is permitted in matters of annexation. Should a provision be included in the Subdivision Control Ordinance to regulate this matter, the conditions under which the Village would request the public improve- ments to be completed in a diligent and timely manner ought to be delineated. As an example , the Village could request the completion of certain public improvements when : - 80% of the subdivision is completed; - performance guarantees are renewed by the developer, - a final plat of subdivision is submitted for Village approval ; - a roadway is considered by the Village to be an integral component in enhancing traffic flow between subdivisions. . . .continued -2- Please let me know if the Village Attorney should prepare an amendment to the Subdivision Control Ordinance which would enable the Village to request early completion of certain public improvements GEP:mw/attachment c: Village Manager Village Attorney Village Engineer Developer and Village acknowledge that the Village has an interest in assuring those persons who may purchase buildings constructed on the tract that public improvements serving such building units shall be installed and usable within a reasonable time, and further acknowledge that not- withstanding the posting of security by the Developer for the installation of public improvements, additional remedies are needed by the Village in order to adequately protect such interest. It is, therefore, agreed that should the public improvements required to be installed by the Developer pursuant to Village ordinance not be completed or not be in the process of being completed in a diligent and timely manner within two (2) years after the issuance of the first building permit in the subdivision unit in which said improvements are located, the Village Board of Trustees may, in the reasonable exercise of its discretion, upon fifteen (15) days' written notice to Developer withhold building permits, occupancy permits, or inspections for any building units located within the Subject Property until such time as the Village Board of Trustees is reasonably satisfied that such public improvements have been completed or will be completed in a diligent and timely manner. Village agrees that in exercising its reasonable discretion herein, the village shall take into account and duly consider delays in construction which have resulted from causes beyond the reasonable control of Developer.
