HomeMy WebLinkAboutCAPITAL IMPROVEMENTS - 10/04/1983 - --------------------- CAPITAL IMPROVEMENTS COMMITTEE Tuesday, October 4, 1983 Members Present: Staff Present: Michael Tosto, Chairman Gary Parrin Ronald Chernick Ray Peterson Stephen Uhlarik Others Present: Jim Callaghan, President, Roundtree Commons Homeowners Association Ken Miller The meeting was called to order by Chairman Tosto at 7 p.m. in the Trustees' Conference Room of the Municipal Building. The purpose of the meeting was to discuss the acquisition of easements by the Roundtree Homeowners Association. Jim Callaghan advised the Committee that sidewalk installation requires the acquisition of easements. The necessary easements would be on private property, not on common property. Since the Association does not have the ability to acquire easements on _private property, each unit owner and mortgage holder must authorize the dedication of easements. Ken Miller added that a number of units are held in trust and the beneficiary of the trust would be extremely difficult to find. Callaghan requested the Committee to reconsider its posture on requiring sidewalks. It would be next to impossible to obtain permission from all the homeowners and mortgage holders to dedicate an easement across private property. There are currently sidewalks within the development, although not in conformance with village requirements. Miller felt that the aesthetics of the subdivision would suffer by the installation of additional sidewalk. Ron Chernick stated that he understands the problems and the difficulties faced by the Association. The installation of sidewalks is for the health, safety and welfare of the residents, and aesthetics Is not a criteria. Public improvements need to be acquired up-front. If the Village does not obtain a commitment from the Association during our deliberations, the Village could be faced with the future installation of sidewalks at the Village's cost. Ray Peterson noted that there are easements required for the underground improvements as well as the sidewalks. The Association must address those easements also. During earlier discussions on the Village acceptance of private improvements, Callaghan confirmed Parrin's statement that the Association felt that it had the ability to acquire whatever easements would be necessary to provide the Village with access to improvements that would Capital Improvements Committee Page 2 October 4, 1983 be dedicated to the Village. Subsequent review by the Association's attorney, however, revealed that the Association could only grant easements across its common property. Chernick suggested that the Association: (1) Obtain as-built engineering drawings in order to locate the underground utilities. The as-built drawings would also be very beneficial for the surveyor to determine the actual placement of the utilities in relation to the private and common properties. (2) Continue to have a surveyor prepare the plats of dedication and determine the actual location of underground improvements. Callaghan and Miller will also discuss the matter of private property easement acquisition with their attorney. An amendment to the Association's by-laws may help to resolve this issue.
