INDUSTRIAL DRAINAGE DITCH PUBLIC HEARING
At 7:10 p.m. Chairman Tosto called a continuance of the
January 17, 1984 Industrial Drainage Ditch Public Hearing to order in
the Council Chambers of the Municipal Building. Due to the lack of a
quorum, the Public Hearing was continued until Tuesday, May 15, 1984 -
7:00 p.m.
The Hearing adjourned at 7:12 p.m.

- AMENDMENT TO SECTION 11.103
MUNICIPAL CODE
At 7:15 p.m. Trustees Tosto and Chernick, John Bria and
Ray Peterson met in the Trustees Conference Room to discuss the proposed
amendment to Section 11.103 of the Municipal Code - see attached. All
agreed the proposed insurance requirement is good to protect the Village,
and conscientious contractors have insurance meeting these requirements.
Mr. Bria did indicate the cost of the umbrella liability coverage
may prevent very small contractors from working in the Village, but the
majority of good contractors already have this coverage. Mr. George
Hartman, President of C. B. Construction Co. , had reviewed the proposed

amendment and responded in writing to the Village Engineer (see
attached) . He had no objections and went so far as to recommend
licensing and requiring surety bonds from all contractors. Copies of
Mr. Hartman's transmittal was given to those present.
The Committee will recommend the adoption of this insurance
amendment to the Municipal Code. In addition, they will recommend the
JPZ Committee place on their agenda Licensing of Contractors.
The meeting adjourned at 7:35 p.m.

AN ORDINANCE AMENDING SEC. 11. 103 OF
THE MUNICIPAL CODE OF THE VILLAGE OF
ELK GROVE VILLAGE THEREBY REQUIRING
CERTIFICATES OF INSURANCE FOR ALL
CONTRACT WORK IN THE VILLAGE RIGHT-
OF-WAY
BE IT ORDAINED by the President and Board of Trustees
of the Village of Elk Grove Village, Counties of Cook and
DuPage, Illinois as follows :
Section 1: That Sec. 11. 103 Bond, of the Municipal
Code of the Village of Elk Grove Village be and the same
is hereby amended by deleting the present language contained
therein so that said Section shall read as follows :
Sec. 11. 103. Bond - Insurance.
Each Applicant shall file a bond, in the amount of
Fifty Thousand ($50 , 000. 00) Dollars with sureties to
be approved by the President and Board of Trustees ,
conditioned to indemnify the Village from any loss or
damage resulting from the work undertaken or the manner ,
of doing the same.
Each Applicant shall further provide evidence to the
Village of insurance, said Certificate of Insurance to
name the Village of Elk Grove Village as an additional
party insured and be sufficient to cover all contract
work to be performed including work performed by the
General Contractor and any subcontractor and shall be
in the following amounts :
1. Comprehensive General Liability insurance for
each occurrence in the sum of $100 , 000 . 00 and
aggregate in the sum of $300 , 000 . 00 .
2. Property damage in the amount of $100 ,000 . 00
for each occurrence.
3. Comprehensive automobile liability in the amount
of $100 , 000 . 00 for bodily injury each occurrence
and $300 ,000 .00 for bodily injury aggregate , and
$100 , 000 . 00 property damage for each occurrence.
4 . Excess Umbrella Liability in the amount of
$1, 000 , 000 . 00 to cover claims exceeding the above
principal coverages .
5 . Worker' s compensation.
6 . Employer' s Liability $100 , 000 . 00 each accident.
Each Certificate of Insurance shall contain a provision
requiring a ten (10) day minimum written notice to the
Village prior to cancellation of the policies.
Section 2 : That Sec. 11. 121 Penalties , of the Municipal
Code be and is hereby amended to read as follows : -
Sec. 11. 121. Penalty.
Any person, firm or corporation violating any of the
provisions of this Article shall be fined not less than
Twenty-five ($25 . 00) Dollars nor more than Five Hundred
($500. 00) Dollars for each offense; and a separate offense
shall be deemed committed on each day during or on which
a violation occurs or continues.
Section 3: The Village Clerk is hereby authorized to
publish this Ordinance in pamphlet form.
Section 4: That this Ordinance shall be in full force
and effect from and after its passage, approval and publication
according to law.
