Chairman Glass called the meeting to order at 8:04 p.m.
ITEM A: Hardees Restaurant - Special Use Permit, Docket 93-2,
Public Hearing
The petitioners were sworn in by Secretary Geinosky.
Wayne Workman opened with a brief summary of the Hardee's
franchise. He stated that it is a fast food business much like that of
McDonald's. This particular Hardees' will employee 55-60 people, 20-25
full time. It will serve all three meals and may be open for 24
hours. Workman also stated that he had done considerable research of
the area and came to the conclusion that the southeast corner of
Busse/Greenleaf was the best location due to the Industrial Park
traffic activity.
Bill Olson explained that the building will contain three parts;
seating area, sales area and a kitchen. There will be a double drive
thru service with two windows, one of which will be a cash window. The
building will consist of glass , masonry and asphalt shingles with a
bright color scheme. Outdoor seating at the north end of the building
is a future option.
Full access will be available on Greenleaf Avenue and a right-in,
right-out only point of egress/ingress is planned on Route 83 (Busse) .
Off of traffic entering the site will be directed to make a loop around
the building before entering the drive thru lanes. A pork chop median
is planned near the entrance of the drive thru lanes to prevent cars
entering the site off Busse Road to immediately enter those lanes. The
outside drive thru line will have a stacking space of seven(7) cars.
The inside lane will hold six(6) cars.
Olson stated that the building will be 118 feet in length and 41
feet wide. The building will be 4,000 square feet. There are 79
parking spaces available of which 4 are designated as handicapped
parking. Olson mentioned the possibility of moving those handicap
stalls to another location in order to have more aisle way space
available. In addition, Olson stated that landscaping will be provided
in accordance with Village ordinances.
Olson then addressed the six comments made by the Director of
Engineering and Community Development, Alan Boffice in his May 27
memorandum and stated that they will comply with all requests as stated
in the memorandum.
Commissioner Meyers questioned the effectiveness of the pork chop
median to prevent access to the drive thru lanes when entering the site
off Busse Road. Olson stated that the pork chop median will act as a
barrier to prevent cars from making the immediate access off Busse
Road. In addition, signage and directional arrows will also be
installed in order to direct motorists.
Commissioner Feichter questioned if the restaurant would be open
24 hours a day. Mueller stated that the restaurant will most likely be
open from 6 a.m. - 11 p.m. unless there is a demand for a 24 hour
operation.
Commissioner Feichter questioned if there had been any traffic
study on the proposed site. Olson stated that a traffic study was not
done.
Commissioner Feichter questioned if item 6 from staff comments had
been addressed. Olson stated that landscaping will be planted at the
rear of the site (detention area) as requested by staff.
Commissioner Geinsoky questioned the hazard posed to disabled
persons if their parking spaces were moved across the drive thru lanes
as proposed by Olson. Olson stated that those spaces will not be moved
as it was only a thought since the number of parking spaces exceed what
is required by ordinance by 11 spaces.
Commissioner Geinosky requested that traffic be directed one way
only, counter clockwise, to eliminate all cross traffic on-site. In
addition, Geinosky requested that all parking spaces be angular to
accommodate the one-way traffic. Olson stated that will be done.
Commissioner Geinosky questioned as to what the current hours of
Portillo's and McDonald's were. Olson stated that Portillo's is open
until 8 p.m. and McDonald' s from 6 a.m. to 11 p.m.
Commissioner McAllister questioned the possibility of trees on the
south and of the property. After viewing aerial photos of the site it
was determined that the trees in question were not on the subject
property.
Commissioner McAllister questioned the use of the double drive
thru, specifically the safety of the services who would assist the
outside lane. Mueller stated that in his 23 years at Hardee's there
has never been a safety problem in this type of layout.
Commissioner Parker questioned as to when the 2nd drive thru lane
would be open. Mueller stated that is would only be open at peak hours
which typically occur at breakfast and lunch time hours.
Commissioner Parker questioned the possibility of inadequate
stacking space. Mueller stated that this would be unlikely because the
restaurant design is focused on providing fast service to drive thru
customers , which constitutes over half of their business.
Commissioner Parker questioned how many parking spaces they would
lose if they converted to all angular parking. Olson stated they
expect to lose 4 spaces which provides for a total number of spaces
that exceeds the number required by Village ordinance.
Commissioner Meyers questioned if the restaurant will be open on
Saturdays and Sundays. Mueller stated that yes , they intended to do
business on weekends.
Chairman Glass questioned the placement of the entrance/exit door
on the east side, expressing concern to pedestrians considering the
close proximity to cars exiting the drive-thru lanes. Olson stated
that it would be feasible to install a handrail outside the door to
direct pedestrian traffic further to the north.
Chairman Glass opened the hearing to the audience.
Bill Pankiw, the owner of Marathon, questioned the placement of
new utility poles on Route 83. Olson stated that he was unaware of the
poles but they should not be a problem as they are located off of the
subject property.
Pankiw questioned the time frame of construction. Olson stated
that they would like to begin construction in August and open in
October.
Chairman Glass closed the Public_ Hearing at 8:52 p.m.
Commissioner Geinosky moved to grant the Special Use Permit for
the construction of a Hardee' s Restaurant in an I-2 zoned district
subject to the following conditions:
- provision of angular parking; and
- installation of an outdoor handrail at the
east side entrance to direct pedestrian traffic
further north. '
Commissioner Parker second the motion
Upon voting, All AYES (Henrici , Paliganoff, Ayers ABSENT) the
motion carried unanimously.
Commissioner Geinosky amended his motion to add a condition that
all staff comments from the May 27 memorandum be incorporated to the
Site Plan. Feichter seconded the motion. Upon voting All AYES
(Henrici , Paliganoff, Ayers ABSENT) the motion carried unanimously.
Adjournment: Commissioner Feichter made a motion and Commissioner
Geinsoky seconded to adjourn meeting. Chairman Glass adjourned the
meeting 8:55 p.m.

Subject: Finding of Fact - Special Use Permit
To allow Hardee ' s Restaurant in an I-2 Zoned District
The Village has been petitioned by Hardee' s Restaurant, for a
Special Use Permit to construct a Hardee ' s Restaurant in an I-2
zoned district located at the southeast corner of Busse and
Greenleaf . Restaurants are permitted in industrial zoned
districts as a special use.
The Plan Commission held a public hearing on the proposed
Special Use Permit on June 16, 1993 .
At the Public Hearing it was learned that the Hardees
Restaurant will be 4 , 000 square feet and operate a double drive
thru window service. The second double drive thru will only
operate at peak hours and runs adjacent to the primary drive thru
lane on the same side of the building. The drive thru lanes
begin at the south side of the building and terminate at the east
side of the building. Since the second drive thru lane is not
directly adjacent to the building, a Hardee' s employee will be
stationed outside to assist those customers using that drive thru
lane.
It was learned that the 102 by 41 foot restaurant will have
indoor seating with the possibility of adding outdoor seating to
the north side of the restaurant at a later date. Approximately
79 parking spaces are planned for the location which exceeds the
68 spaces required by ordinance.
There are two points of egress/ingress planned for the
location; a right in/right out only on Busse Road and a full
access on Greenleaf Avenue. The Plan Commission suggested that
there be signage and directional arrows on site to direct traffic
one way in a counter clockwise direction in order to eliminate
cross traffic flows . In addition, the Plan commission suggested
to eliminate the mixture of angular and perpendicular parking and
have all angular parking in order to accomodate the one way flow
of traffic . Finally, the petitioner agreed to add a pork chop
median near the entrance of the drive thru lanes in order to
discourage traffic entering from Busse to immediately enter the
drive thru lanes which may cause stacking of cars onto the Busse
Road entrance/exit.

The Plan Commission expressed concern regarding the safety of
pedestrians exiting the east side of the building given the close
proximity of the cars exiting the drive thru lanes at that
location. The petitioner agreed to install a handrail parallel
to the building that would direct pedestrian traffic further
north before entering the parking lot .
Upon further deliberation, the Plan Commission voted
unanimously (Henrici, Paliganoff, Ayers ; ABSENT) to recommend
that the Village Board grant the Special Use Permit for a
Hardee' s Restaurant in an I-2 zoned district with the following
conditions :
- To revise the Site Plan to show all angular
parking;
- To install a handrail on the east side of the
building to direct pedestrian traffic at the
west entrance/exit; and
- To incorporate all revisions as recommended in
the Director of Engineering and Community
Development ' s memorandum dated May 27 , 1993
