Henrici J. Meyers J. McAllister P. Feichter ABSENT: P. Ayers D. Paliganoff T. Parker STAFF: R. Farrell , Administrative Assistant M. Pye, Assistant Village Engineer PETITIONER: R. Gaston, Arlington Partners S. Lesak, JKL Consulting Engineers, Ltd. Chairman Glass called the meeting to order at 8:05 p.m. Item A: Spruce Meadow Subdivision Gaston informed the Commission that he spoke with Dean Phillips regarding the plat of subdivision. Gaston noted that Phillips did not have any concerns with the proposed development. In regards to the maintenance of the two vacant pieces of land Gaston mentioned two alternatives to the Homeowners Association: - Ms. Omelusik (homeowner of the outlot) is willing to take both pieces of land if she is compensated by the developer; or - Give the piece of land that is closest to Arlington Heights Road to Omelusik and extend the cul-de-sac right-of-way at the second point to provide for a wider cul-de-sac. Pye stated that extending the cul-de-sac right-of-way is not recommended by staff as the cul-de-sac meets Village code per its current design. Chairman Glass stated that he had no problem with the Homeowners Association as long as the vacant parcels are maintained and secured through a legal covenant. Plan Commissi(,. Minutes February 2, 1994 p9 2 Gaston stated that the County will approve the curb cut on Arlington Heights Road for lot 9. In addition Gaston submitted a drawing (attached) showing two separate driveways for lot 8 and lot 9 from Meadow Court. Pye stated that staff prefers Meadow Court access for lot 9 due to the traffic hazards present on Arlington Heights Road in that area. In addition Glass noted that historically the Village has prevented homeowner access from other busy roadways such as Devon and Meacham. Glass stated his favor for the access off of Meadow Court. Commissioner Meyers stated that a circle drive at the southern portion of lot 9 with a right in, right out only access would not pose a safety danger. Commissioner Henrici questioned if the developer would eliminate the 20 foot building line at the eastern portion of lot 9 if access were provided off of Arlington Heights Road. Gaston stated that since the home would face Arlington Heights Road the 20 foot building line would be eliminated. Commissioner Geinosky questioned if all the concerns regarding flooding and basements were resolved. Gaston stated that they were resolved. Pye noted that the developer will need staff approval plus a FEMA permit to construct basements. Overall the Plan Commission expressed concern that the subdivision would be near an immediate floodway, there have been past incidents of flooding in the Village, there is a potential risk of flooding in that area and that the development is too dense. After further deliberation Commissioner McAllister motioned to recommend to the Village Board to approve the plat of subdivision subject to the following conditions: - Provide access for lot 9 in a right in, right only design off of Arlington Heights Road; - All language for the necessary easements be approved by staff; and - All language for the covenants to provide for a Homeowners Associated be approved by staff. Commissioner Geinosky seconded the motion. Upon voting, three(3) NAYS (Meyers, Henrici , Feichter) and two(2) AYES (Geinosky, McAllister) were counted (Parker, Ayers, Paliganoff ABSENT) .
