Burton, Land Consultants Chairman Glass called the meeting to order at 8:07 p.m. Item A: Lexington Homes Annexation, Rezoning, Special Use Permit Neeley stated that a revision to the development plan may be necessary in order to receive approval from the Army Corps of Engineers. The Army Corps may require the change in order to remove some of the building pads from the wetland area. The revisions would include: - the elimination of the 6-unit townhome parallel to the soccer field on the opposite side of the wetland; - converting the 4-unit t,ownhome located north of the pond along I-290 to an 8-unit building; - converting the 4-unit t,ownhome east of the recreation parking area to a 6-unit building. The density of the development would remain the same with the change. The change would however increase the number of coachhomes by 4 units and decrease the numbEr of townhomes by 4 units. In addition, Neeley stated that the window glazing for homes along I-290 would be increased from 29 to 32 STC. This would result in a lower interior sound level from 41 to 44 LDP! to 39 to 41 LON. Plan Commission ,nutes March 16, 1994 pg 2 Commissioner Henrici questioned if the construction of balconies on the homes would encroach onto the 30 foot building envelopes. Neeley stated that there would be no encroachment into the 30 foot envelope. In addition, if the revision to the plat were made there would be a .2% increase in the common open space due to the increase in coachhomes and decrease in townhomes. Commissioner Geinosky questioned if there was still a concern over the number of parking spaces in the development. Neeley stated that 19 spaces had been added since the first meeting. In addition, they will try to add 8 more guest parking spaces in the southern portion of the development with 4 additional spaces near Huntington Court and 4 on Hawthorne Lane. Commissioner Paliganoff questioned if a fence would be installed on the berm along I-290. Neeley stated that they would not be willing to construct a fence due to the maintenance problems that would occur. Neeley added that the proposed landscaping in addition to the increased window glazing would be a sufficient barrier to the traffic/noise. Commissioner Meyers questioned the minimum distance of the buildings to the I-290 pavement. Neeley stated that the property line was approximately 142 feet from the I-290 pavement. In additions there is a 50 foot minimum requirement from buildings to the property line. In total there is a 192 foot minimum distance from the I-290 pavement to the buildings. Discussion occurred regarding the reduction in right-of-way width from 60 feet to 50 feet and the possibility that the reduction may cause the development to appear congested. Neeley stated that the current requirement of a 60 foot right-of-way is combined with a minimum required set back of 15 feet which would require a 90 foot distance between fronts of buildings. Under the proposed plan, the 50 foot right-of-way would include a set back of 22 feet thus creating a distance of 94 feet from front to front. Neeley noted that this would in effect reduce the appearance of congestion. Chairman Glass stated that the water tower would be classified as a municipal purpose use in a residential zoned district and therefore a special use permit would be necessary for it to be constructed on this site. Chairman Glass noted that the location and special use permit for the tower would need to be voted on tonight. After further deliberation, the Plan Commission took the following action: Plan Commission Lutes March 16, 1994 pg 3 Commissioner Henrici moved and Commissioner Paliganoff seconded the motion to recommend the Village Board approve the rezoning of the subject property from Cook County R-3 to A-2 Multiple Family Residential District and to grant a special use permit to provide for a planned unit development. Upon voting (all AYES) , the motion passed unanimously. O� Commissioner Paliganoff and Commissioner Feichter seconded the motion to recommend the Village Board grant variances for the development from the Subdivision Control Ordinance and Zoning Ordinance as follows: - No alleyways as required by Section 8-12B-1-1A2 of the Subdivision Control Ordinance - Variation from Section 8-12B-1-1A3(d) of the Subdivision Control Ordinance to allow a reduction in the right-of-way width from 60 feet to 50 feet for all streets with the exception of Huntington Drive and Charlela Lane - Variation to allow a portion of the public side- walk on Rohlwing Road to be located outside of the right-of-way. - Variation from Section 5.34E(1) of the Zoning Ordinance to reduce the common open space area from 50% to 48.5% - Variation from Section 5.22 of the Zoning Ordinance to include as a permitted use in a residential district offices and model units for the purpose of selling units on the subject property. - To allow under Section 3.946 of the Zoning Ordinance seventeen (17) foot paved parking stalls with two (2) foot overhang - Variation from Section 8-12B-1-146 of the Subdivision Control Ordinance to allow a reduction in the length of street jogs from 125 feet to 100 feet for construction of the Windham Lane/Hawthorne Lane street jog. Upon voting six AYES (Geirosky, Henrici , Feichter, Ayers , Paliganoff, McAllister) and one NAY (Meyers). The motion passed by a count of 6 to 1. Commissioner Ayers moved and Commissioner Feichter seconded the motion to approve a Special Use Permit for the construction of a water tower at the southeast corner of the development. Upon voting all AYES. The motion passed unanimously. Commissioner Meyers moved and Commissioner Henrici seconded the motion to approve the landscaping and screening plan as presented. Upon voting five AYES (Ayers, Feichter, Meyers, Henrici , Geinosky) and two Plan Commission inutes _ March 16, 1994 pg 4 NAYS (Paliganoff, McAllister) were counted. The motion passed by a count of 5 to 2. Commissioner Geinosky moved and Commissioner Henrici seconded the motion to recommend the Village Board approve the preliminary development plat subject to the following conditions: - Increase the window glazing for buildings that abut I-290 from 29 to 32 STC; - Provide 8 more parking spaces in the southern portion of the development of which 4 will be on Hawthorne Lane and 4 next to Huntington Court; - Move the 4-unit coachhome from the southeast corner to the northwest corner to accommodate the placement of a water tower; and - Eliminate the 6-unit townhome parallel to the soccer field opposite the wetland and the conversion of the 4-unit townhome located north of the pond along I-290 to an 8-unit building and the conversion of the 4-unit town- home east of the recreational parking area to a 6-unit building in the event that the Army Corps of Engineers mandates such a change. Upon voting, all AYES. The motion passed unanimously. Adjournment: Commissioner Meyers motioned and Commissioner Ayers seconded the motion to adjourn the meeting.
