Plan Commission Minutes
September 20, 1995

Chairman Geinosky opened the meeting at 8:00 p.m.
Item A: Centerpoint - Chase Subdivision
Breslin stated that the subject property is a 16.1 acre parcel
located at the northwest corner of Chase Avenue and Lively Boulevard.
Breslin stated that the petitioner, Centerpoint Properties Corporation,
was seeking to subdivide the property into four separate industrial
lots for the purpose of selling the property to individual parties.
Breslin stated that the largest lot would be Lot #1 (508, 865
square feet) located on the west side of the property. This lot was
currently occupied by General Tire Corporation which has an existing
business at that location. Lot #2 (136, 517 square feet) , which is
currently vacant, is in the process of being sold to Rainbow Fish
House, Inc. Rainbow Fish House will be seeking a special use permit to
allow a food processing facility at the property located on Lot #2.
Centerpoint plans to sell Lot #3 (25,636 square feet) and Lot #4
(29, 110 square feet) to another developer at a later date.
Chairman Geinosky asked the petitioner to respond to staff
comments found in the Director of Engineering and Community
Development's September 7, 1995 memo. Breslin stated that he had
received the staff comments and that the plat of subdivision dated
September 12, 1995 provided to the Plan Commission addressed all of
staff 's comments with the exception of number 2 as it pertained to the
inclusion of easement language. Breslin stated that the linen had been
corrected to respond to the comments correctly. Niehaus confirmed that
the linen was acceptable.
Commissioner Henrici questioned the status of the existing
building on Lot #3 and whether or not it met the minimum setback
requirements. Breslin stated that the building was currently vacant
and would possibly be used by the purchaser of the property. Breslin
stated that the dimensions of the subdivision met the minimum setback
requirements for the existing building on Lot #3.
Commissioner Henrici questioned as to why staff did not require a
10 foot utility easement on the east side of Lot #2. Niehaus stated
that staff had reviewed the subdivision and determined that the
petitioner had met all village requirements for rear yard easements and
that no additional easements were required on the property.
Commissioner Henrici expressed his concern that an easement should
be provided on the east side of Lot #2 to abut the rear yard easements
on Lots #3 and #4. The consensus of the Plan Commission was to have
staff look at this issue and address it during the Special Use Permit
process for Lot #2 (Rainbow Fish House) if necessary.
Upon further discussion, Commissioner Ayers moved and Commissioner
Feichter seconded the motion to recommend approval of the
Centerpoint - Chase Subdivision. Upon voting (Feichter, Geinosky,
Meyers, Prochno, Ayers, McAllister AYES, Henrici ABSTAIN, Guzzardi,
Paliganoff ABSENT) , the motion carried.
Niehaus provided the Plan Commission with an update on the current
status of items which appeared on the Plan Commission agenda in 1995.
In addition, Niehaus informed the members of the upcoming issues which
may be brought to the Plan Commission.
Commissioner Feichter moved and Commissioner Ayers seconded the
motion to adjourn the meeting.
Chairman Geinosky adjourned the meeting at 8:45 p.m.
