Trudan, Assistant Director of Community Development Chairman Glass called the meeting to order at 8:35 p.m. Item 1: Approval of Minutes Commissioner Ayers moved and Commissioner Sokolowski seconded a motion to approve the minutes from the July 7 and July 21 Plan Commission meetings. Upon voting, the motion carried unanimously (Glass,Ayers, Henrici, Sokolowski, Thompson, Zizzo,AYES, Geinosky, Meyers, Paliganoff, ABSENT). Item 2: Text Amendment—Storage Sheds Chairman Glass stated this hearing follows a previous hearing on this matter held on July 21, 1999, which was continued so staff could look into alternative language suggested by the Plan Commission. S. Trudan explained that at the proposed regulations for storage sheds are intended to allow residents to make better use of their properties by locating sheds closer to side and rear yard lot lines. He explained that storage sheds should be considered separately from other accessory structures such as swimming pools and gazebos because sheds are a passive use. Trudan reviewed the discussion from the last meeting. He explained there was consensus on defining height as "measured to the highest point of the structure". He explained staff preferred a front yard setback of 60 feet, while the Plan Commission suggested that sheds be located behind the rear of the rear foundation line as extended to the side lot lines. Finally, staff recommended a 15 foot height restriction, while the Plan Commission suggested a 12 foot height restriction. Trudan stated staff had reviewed the alternative language proposed by the Plan Commission, and after applying alternative regulations to several scenarios, found that initial staff recommendations worked best. The Plan Commission's concerns about the 60 foot front yard setback were related to exceptionally deep lots which are rare in the village. In addition, the use of the rear foundation line can become problematic in situations where additions are added to the rear of a house. Trudan recommended that the Plan Commission reconsider staff s recommendations. Commissioner Zizzo stated she recommends the 12 foot height restriction and would prefer to reduce it to 10 feet. Trudan stated that 15 feet is fair,is consistent with the restrictions used by other municipalities, and would help minimize the number of variation requests for sheds construction. Commissioner Sokolowski asked if residents would be limited to one shed. Trudan replied the Zoning Ordinance currently allows one principal and one accessory structure. Commissioner Henrici stated that a shed and a gazebo would count as two accessory structures. Trudan agreed and stated the intent of the ordinance is to prevent multiple occurrences of the same structure. Commissioner Thompson stated he concurs with staff recommendations. Chairman Glass stated the regulations could be written to provide for a 60 foot front yard setback or the rear foundation line, whichever is more restrictive. Trudan replied that staff's intent was to relax restrictions on storage sheds, and would prefer not to add language that would make storage shed regulations more restrictive than those applied to other accessory structures. Michelle Graves, 575 Gateshead North, stated she was denied a permit for a storage shed which was smaller than her neighbors' sheds which are located in their side yards. She explained her shed was planned for the back yard and cannot understand why her permit was denied. Chairman Glass stated the location of sheds in side yards is an enforcement issue, and asked she speak with Mr. Trudan after the meeting to discuss her issue in light of the language revisions to the Village's storage shed regulations. Following additional discussion,Commissioner Henrici moved to recommend to the Village Board approval of a text amendment to the Zoning Ordinance for the following regulations: • A height restriction of 15 feet for all accessory structures as measured to the highest point of the structure; • That storage sheds be located at least 60 feet from the front lot line; • That storage sheds be located at least two feet from the required side and rear yard lot lines. Commissioner Ayers seconded the motion. Upon voting(Glass, Ayers,Henrici, Sokolowski, Thompson,Zizzo, AYES, Gemosky,Meyers,Paliganoff,ABSENT)the motion carried unanimously. Adjournment: Commissioner Sokolowski moved and Commissioner Zizzo seconded the motion to adjourn. Chairman Glass adjourned the meeting at 9:15 p.m. Res ectfully submitted, eter J.
