PROCHNO Village Trustee Pursuant to a duly made and approved motion and a majority vote at a regularly scheduled meeting of the Village President and Board of Trustees on December 14. 2004 ,this Executive Session was called to consider a Litigation matter. Number of pages attached: I Date(s)of review for release: December 2005 Date of approval for release: ( L) 6-o(og- (K-0( 12/14/2004 6:40 p.m. Litigation Mayor Johnson stated that the Village prevailed in its lawsuit with Nerge LLC. As a result, the Village will not have to pay the plaintiffs any money. The only costs to the Village were for our own legal defense. The former owners of Ringside Sports (Merge LLC)brought on this lawsuit. Following the Village's negotiations with Home Depot to locate at the Rohlwing Grove Shopping Center, the plaintiff claimed all of their tenants left the center as a result of the Village's TIF requirements and disclosures. The Judge disagreed and plaintiffs may appeal. The meeting adjourned at 6:44 p.m.
