PROCHNO Village Trustee Pursuant to a duly made and approved motion and a majority vote at a regularly scheduled meeting of the Village President and Board of Trustees on December 14, 2004 ,this Executive Session was called to consider a Liti ag tion matter. Number of pages attached: 1 Date(s)of review for release: December 2005 4 Date of approval for release: ('E K\0 S.o(o -A- (y-pfo 12(14(2004 6:44 p.m. Litigation It was noted that the Village lost its appeal of the Disconnection Fee ruling originally issued in favor of the City of Chicago. The Village Attorney will review the case to determine whether or not we should appeal to the Illinois Supreme Court. The Mayor stated that if the City of Chicago only had plans to take a few acres from the Village, they would not have filed the lawsuit the very next day following the Village's adoption of the Ordinance. A statement was made regarding a current Supreme Court case against a Michigan municipality for taking property for economic betterment of the community at the demise of others. The meeting adjourned at 6:45 p.m.'
