Rettenbacher Members Absent: Carl Collmer Robert Phillips 7:45 p.m. Docket 85-7 Anthony and Barbara Olita, 963 David Lane The petitioner requested a two (2) foot variation from our required eight (8) foot sideyard to permit a fireplace to be installed. The petitioner did not appear. The Zoning Board recessed the hearing to a date to be set by the Chairman. 8:00 p.m. Docket 85-2 James A. and Karen D. Hoppe, 1095 Florida Lane This hearing was heard September 16th and October 21st and then continued to November 18th to permit members to review the transcript and for the homeowner to present additional testimony. The petitioner stated that he felt his proposed pool in the side twenty- five (25) foot building setback and with a wood fence at the sidewalk would not be detrimental to the area since his lot abutted (on the rear) to a large area that is now a mud field and across the street was the Village well site and reservoir. He stated that he would have to remove some plantings and maybe a portion of his patio if he put the pool in his rear yard. The Board voted to deny the request and will submit a finding of fact to the Village Board. They requested the petitioner to contact the Village Clerk to find out when the recommendation will be before the Village Board. 8:30 p.m. Docket 85-5 Jay L. Baylian, 211 Harmony Lane This hearing was first heard October 21st and then continued to November 18th to permit members to review the transcript and for the homeowner to present additional testimony. At the previous hearing the neighbor on the east side of this pool appeared and objected to the pool (the above ground pool was installed two (2) years ago by the homeowner). The pool is only three (3) feet from the side lot line, not the required eight (8) feet and is four (4) feet into a ten (10) foot easement and only six (6) feet from the rear lot line, not eight (8) feet. Zoning Board Minutes November 18, 1985 Page 2 After a review and discussion the Zoning Board agreed that to drain the 10,000 gallons of water and then move this pool five (5) feet in one direction and four (4) feet in another would be a hardship on the homeowner. The homeowner did not know a permit was required when the pool was installed and would have applied if he had known. The petitioner was informed that the variation could only be granted if the Village Board would permit the pool to project four (4) feet into the ten (10) foot easement. Thomas F.
