The petitioner Mr. Lee Davis, 401 Charles Drive, introduced himself and
presented his case. He had started to erect the front deck without a
permit when he was stopped by a Building Inspector. When he applied,
he was informed that he did not: meet the zoning requirements for setback
both for the existing structure and the proposed deck. He decided to
seek a variation to permit the deck.
Because of the trees in front of his residence the front door was not
readily identifiable. Visitors always arrived at the rear door on Cosman
Road. He felt by installing a front deck on Charles it would provide a
place to relax and also identify the front entrance. He also plans to
construct a walk from the sidewalk to his deck. The landscaping that
exits he felt was too valuable to remove or try to relocate since it has
been in place for a number of years (before he purchased the home) . Since
the deck was more than 75% constructed when he applied, he finished the
construction realizing that if his request was denied he would have to
remove the deck. The deck is 10 ft. X 31 ft. and 2-1/2 ft. above grade.
He presented letters from his neighbors to his South, Mr. and Mrs. George
Rizzio, 431 Charles Road and across the street, Mr. H.W. Paul, 285 Cosman
Road stating they did not object to the deck.
No objections were received.
Mr. Inzerello moved and Mr. Carey seconded motion to recommend that variations
sought be granted. The vote was unanimous.
