Chairman Inzerello called the meeting to order at 7:02 p.m, and
summarized the Legal Notice for the hearing.
Residential Zoning Variation - Docket 94-11, 590 Sycamore
Mr. Gallagher explained that his reason for seeking a variation was
that during the summer he put up a pool which encroaches 1 foot 3
inches into the minimum eight foot setback required between a pool and
side lot line.
The Zoning Board asked Mr. Gallagher several questions, such as what
type of pool it was? How did the encroachment occur? And who found the
error? Mr. Gallagher replied that the pool was an above ground pool
and that he measured from a neighbors existing fence to determine the
setback. He also said that a Village inspector caught the error off
his plat of survey.
Mr. Inzerello, then asked Mr. Ray if the Village had anything to add.
Mr. Ray stated that Mr. Gallagher applied for a pool permit and
electrical permit June 23, 1994. At that time he was told that the
permit could take up to 7 to 10 working days and that he would be
called when it was ready. On June 27th Mr. Boffice (Director of
Engineering/community Development) had a message to call Mr.
Gallagher. During their conversation Mr. Gallagher asked if he could
begin to fill up his pool. Mr. Boffice told him his application was
still in the reviewing process, but we would like to accommodate him.
He was advised that anything he did now was at his own risk. Mr.
Gallagher said that he followed all our pool regulations and if there
were any problems he would correct them. Mr. Ray then went on to say
that on July 6, 1994 Mr. Gallagher came in to pay for his permit (which
had been ready for pick up for a week) and the following day called in
for an inspection. on July 7, 1994, Mr. Pusateri (Building Inspector)
made an inspection of Mr. Gallagher's pool and found several electrical
violations. Mr. Pusateri advised Mr. Gallagher of the problems and
said he would be back in about a week for a reinspection. On July 12,
1994, Mr. Pusateri went back and still found electrical violations.
Mr. Pusateri also found at that time that the pool was located too
close to the site property line. Mr. Pusateri again advised Mr.

Gallagher about the electrical violations as well as the location of
pool. Mr. Pusateri then told Mr. Gallagher that he would need a zoning
variation for the location of the pool and that he would work with him
regarding the electrical violations while the variation was being
processed. Mr. Gallagher's reply was no problem. Mr. Gallagher
finally came in October 13, 1994 to apply for a variation. At that
time he did not have all the paper work needed and did not come back
until November 4, 1994 to officially apply.
Mr. Inzerello then asked Mr. Gallagher if this was all true to which he
said he thought so. Mr. Gallagher then said he thought the village was
supposed to call him and set up a variation meeting.
The Zoning Board then asked Mr. Gallagher if the electrical violations
had been corrected at this time and he said no. Mr. Gallagher said he
wasn't going to spend any more money if in fact he had to move the pool.
The Zoning Board's final question to Mr. Gallagher was exactly how much
it would cost to move his pool. He said that with the help of a few
friends it would cost about $600.
Chairman Inzerello asked for a motion.
A motion was made by Mr. Phillips and seconded by Mr. Oliveto not to
grant the variation. The motion was passed by unanimous vote not to
grant the variation. The meeting was adjourned at 7:20 p.m.
