Kaplan K. Zizzo R. Herrick M. Coffman J. Oliveto Absent: None Staff: J. Zaucha, Plan Reviewer S. Trudan, Building inspector Supervisor/Plan Reviewer Residential Zoning Variation - Docket 95-13 - 1012 Alabama Drive Chairman Phillips called the meeting to order at 7:33 p.m. and summarized the legal notice for the hearing. Mary McMahon was sworn in by Mr. Phillips and asked to state her case. Mrs. McMahon explained that she mistakenly told the fence installers to place the fence in the wrong place. she then stated that in a very short period of time, the workers set the fence posts and completed the entire fence as directed. Mrs. McMahon stated that she did not realize the fence had extended beyond the 25 foot setback line. A time line of events was then discussed. It was noted that the fence permit was issued in July of 1994 and it wasn't until August of 1995 that the permit was picked-up and made active. It was also pointed out that the fence had been in place for approximately a year and that there was never a posthole or final inspection made until August of 1995. It was then determined that the fence was built without actually having an active permit, it was not installed according to the plans submitted to the Village, and the fence contractor failed to call for a posthole inspection or final inspection. A recess was then called at 7 :55 by Chairman Phillips. At 8:04 the hearing was called back to order. Mr. Herrick motioned not to grant the variation, which was seconded by Mrs. Zizzo. The vote was unanimously in favor of not granting the variation for the following reasons: 1. The fence was in the wrong place. 2. The contractor did not follow approved plans. 3. There was never a posthole inspection requested by the fence contractor. The meeting was adjourned by chairman Phillips at 8:08 p.m. Respectfully submitted, James S.
