Zoning Variation Docket 96-3 - village on the Lake Homeowners'
Association
Chairman Phillips called the meeting to order at 7: 02 p.m. and
read the legal notice. Mr. Kaplan then read the statement of posting
out loud.
Mr. Knuckles, attorney representing the petitioner then explained
the structure of the Homeowners' Association and how the master
association was charged with the responsibility of maintaining the
grounds, streets and parking lots.
Mr. Knuckles then explained his understanding of the history of
the property and added that to his knowledge the parking areas never
did comply with Village codes or the original approved site plan.
Mr. Knuckles explained that the Homeowners' Association wanted to
increase the width of the parking stalls to ten(10) feet for the
convenience of the residents. Mr. Knuckles disputed the Village
records which indicated that the lot was resurfaced and restriped in
1994 to provide a total of 846 parking stalls. Mr. Knuckles claimed
that only 791 spaces were provided at that time.
Lorraine Garza representing the Homeowners ' Association explained
the main reason they chose to widen the spaces to ten(10) feet was for
convenience and to accommodate those people who had to load and unload
their cars, to provide more room for those with walkers, wheelchairs
and crutches.
Jill Barshop, also representing the Homeowners' Association
explained that special permit parking was available for some residents
and that in the seven(7) years she has lived there they have never
experienced a shortage of parking spaces.
Mr. Kaplan inquired about the adequacy of parking at specific
locations around the complex and asked for clarification on why they
chose to widen the spaces to ten(10) feet.
Mr. Rodgers inquired about details pertaining to the special
permit provisions made available to the residents.
Several members of the audience expressed dissatisfaction with the
number of handicapped parking spaces being provide and the locations of
those spaces.
Chairman Phillips explained that the petitioner has in fact
provided the minimum number of handicapped spaces required by code and
that the Zoning Board of Appeals was not the proper forum in which to
discuss those concerns.
Mr. Trudan explained and summarized that the Village records
showed that the complex was built according to village codes and
provided 884 spaces. Over the years some of those spaces were
designated as handicapped spaces as needed. A permit to resurface the
lot issued by the Engineering Department approved a stripping layout of
846 spaces, seventeen(17) of which were handicapped stalls, conforming
to the State requirements.
when the complex decided to seal coat the lot last year they also
restriped to the current configuration. Mr. Trudan added that the only
variation being sought was from the total number of required parking
spaces.
A motion was made by Marianne Coffman to amend the petition to say
the petitioner was requesting permission to reduce the number of
required parking spaces by fifty(50) spaces, from 791 to 741. The
motion was seconded by Joe Oliveto and passed by unanimous vote.
A second motion was made by Paul Kaplan to approve the amended
petition and seconded by Marianne Coffman. The motion was passed by
unanimous vote.
The meeting was adjourned at 8: 15 p.m.
