Meeting Minutes
September 25, 1996

Docket 96-11 - 608 Chelmsford
The meeting was called to order by chairman Phillips at 7:30 p.m.
and the legal notice was read aloud.
The petitioner, David Amedeo explained that a permit was obtained
by the contractor, All Temp Fireplaces and the Village Building
Inspector noticed that the chase for the flue was located in the
required side yard.
Mr. Trudan explained that the plans submitted to the village for
permit did not indicate the construction of an exterior chase on the
plat of survey.
Discussion followed and the petitioner indicated that the proposed
location of the fireplace was the only practical location.
A motion was made by Mr. Kaplan tO grant the variation and
seconded by Mr. Herrick. The motion was approved by unanimous vote.
The meeting was adjourned at 7:45 p.m.

chairman Phillips called the meeting to order at 8: 00 p.m. and
read the legal notice aloud.
The petitioner Nick Loiacono explained that he lives on a corner
lot adjacent to a park and his reason for seeking the variation was due
to the lack of privacy and security on his property. He explained that
children walk through his yard, people cut through his yard to go to
the park, especially when events such as soccer games are taking place,
and people walk their dogs in his yard and allow them to defecate on
the lawn.
Mr. Loiacono also explained that his deck is located along the
side of the house and the fence would provide privacy while the deck
was in use.
Mr. Kaplan asked why the fence was starting at the side of the
house as opposed to starting at the front corner of the deck.
Mr. Loiacono explained that he chose a location that would not
interfere with a gate for the fence or the stairs leading to the deck.
Mr. Herrick asked if he would agree to starting the fence at the
corner of the deck. Mr. Loiacono said that would be fine.
Jim Wassell who lives next to the petitioner asked about the exact
location of the fence and if there would be a section of fence
installed adjacent to his property.
Mr. Loiacono explained that a small section would be installed
between their houses.
Michelle Herzau of 1839 Longboat inquired about whether or not the
fence would cause vision problem for the public and this was addressed
by the Board members who explained that no line of sight problems would
be created.
A motion was made by Mr. Kaplan to approve the variation with the
stipulation that the fence start at the rear of the garage which is the
start of the deck. Mr. Rodgers seconded the motion which was passed by
unanimous vote.
The meeting was adjourned at 8:25 p.m.
