October 9, 1996

Zoning variation - Docket 96-13
Chairman Phillips called the meeting to order at 7:00 p.m. and
summarized the legal notice for the hearing. Petitioners Mr. & Mrs.
Elroy Ehrke were present for the hearing. Mr. Ehrke was sworn in by
Chairman Phillips and asked to present his case.
Mr. Ehrke stated that his pool was incorrectly installed by
subcontractors of the pool company from where the pool was purchased.
Mr. Ehrke continued by stating that after the pool was installed, he
was unable to contact the subcontractor because the subcontractor had
left out of state to North Carolina. He also stated that his neighbors
have had no complaints on the installation.
Mr. Herrick commented that if the pool was to be relocated, there would
probably be no noticeable difference. Chairman Phillips then stated
that to avoid future incidents with incorrectly installed swimming
pools, information on required inspections should be included in the
"Requirements of Swimming Pools" information sheet. Mrs. Coffman added
that if the variation were to be granted, any future pool installations
at this location should meet all zoning requirements. When asked if
the Department of Community Development had any comments, Mr. Zaucha
responded by stating that his department does not look favorably upon
persons who create their own hardship and then ask for a variance.
At 7:20 p.m. Mr. Herrick motioned for a vote which was seconded by Mr.
Oliveto. The vote was unanimously in favor of granting the variation
(P. Kaplan, C. McClleland ABSENT) . The meeting was adjourned by
Chairman Phillips at 7:200 p.m.
