Kaplan R. Herrick T. Rodgers C. McClleland Absent: M. Coffman Staff: J. Zaucha, Plan Reviewer Zoning Variation - Docket 96-15 Chairman Phillips called the meeting to order at 7: 00 p.m. and summarized the legal notice for the hearing. Petitioner Mrs. Tracy Mesh was sworn in by Chairman Phillips and asked to state her case. Mrs. Mesh explained that the location of trees and telephone/cable T.V. lines prevent the pool from being located behind the 25 foot setback. Mrs. Mesh stated that locating the pool directly towards the rear of the house would also not be desirable for the neighbors and their own privacy. Mrs. Mesh further explained that the intent of their previous fence variation was to create more recreational area for their family. The Board asked numerous questions including how far west the petitioner would be willing to place the proposed pool. Mr. Mesh stated that he would be willing to place the pool 10 feet closer to the house. Mr. Herrick noted that due to the proximately of the existing fence in relation to the intersection of Tonne Road and Elk Grove Boulevard, there exists a risk that a vehicle could possibly collide into the fence and pool. When asked for the opinion of the Department of Engineering and Community Development, Mr. Zaucha stated that the intent of front yard setbacks is to keep accessary structures a significant distance from public streets and sidewalks. Mr. Zaucha also stated that unless it was the specific intent of the previously granted fence variation to provide room for a pool installation, the permitted fence should have no bearing on the Board's decision. Piease continue . . . . . . . . . . . . At 7:38 p.m. , Mrs. McClelland motioned for a vote which was seconded by Mr. Rodgers. The vote was unanimously in favor of not granting the variation.
