Zoning variation - Docket 96-17
Chairman Robert Phillips called the meeting to order at 7: 04 p.m. and
summarized the legal notice for the hearing. Petitioner Mr. James
Gallo was sworn in by Chairman Phillips and asked to state his case.
Mr. Gallo stated that his recent marriage with Mrs. Gallo has created
the need for a larger living space. He explained that due to his
disability, building a second floor addition is not economically
feasible nor in the best interest of safety. Mr. Gallo further
explained that his unusually shaped lot limits the distance that which
he can expand towards the rear of the property without encroaching into
the required rear yard. Mr. Gallo also mentioned that his neighbors
have been great and that he does not wish to move to another community.
Mr. Oliveto asked if side yard requirements were being met. Mr. Gallo
replied by saying yes. Mr. Herrick asked if the addition would
necessitate the removal of trees. Mr. Gallo responded by saying two
trees needed to be removed. one of the two trees is already dead and
would need to be removed anyway.
At 7: 15 p.m. , Mr. Oliveto motioned for a vote which was seconded by
Mrs. McClelland. The vote was unanimously in favor of granting the
variation. The meeting was adjourned by Chairman Phillips at 7:17 p.m.
