Zoning Variation - 872 Cass - Docket 97-4
Chairman Phillips called the meeting to order at 7:04 p.m. and summarized the legal notice
for the hearing. Petitioner Mr. Chris Koska was sworn in by Chairman Phillips and asked
to state his case.
Mr. Koska explained that due to the irregular shape of his lot and the location of utility
easements, he has no choice but to install the pool in the proposed location. He further
explained that his lot is not deep enough to meet the 60 foot set-back requirement. Mr.
Schumm asked how tall of a fence is being installed around the rear property. Mr. Koska
stated that the fence would be six feet tall. Mr. Hauser asked how high the pool would be
above ground. Mr. Koska explained that the pool would extend approximately 45 inches
above ground. Mr. Kaplan asked where the filtration equipment would be located.. Mr.
Koska explained that the equipment would be located on the side closest to the house.
Mr. Thompson asked what the diameter of the pool would be. Mr. Koska stated the pool
would be 15 feet in diameter. Mrs. McClelland asked if the Engineering Department had
an opinion. Mr. Zaucha stated that there is no objection to the variation being granted.
Mr. Rodgers asked how much space there is between the fence and the rear property line.
Mr. Koska stated that there is approximately 30 feet. Mr. Phillips asked how much room
would be made for the pool. Mr. Koska explained that the swing set would be removed
and that a tree would be relocated.
Mr. Phillips asked if the public had any questions or comments. Art Contreras, a resident
at 857 Cass Lane stepped forward and was sworn in. Mr. Contreras stated that his
residence is located across the street from the Koska's and that the new fence being
installed is unsightly.
Mr. Castreras explained that he has concerns that the fence installation will lower his
property value. Mr. Contreras further explained that his intent of attending the meeting
was not to stop the Koska's from improving their property, but was merely to voice his
concerns over variances being granted without due caution. __
Mr. Phillips asked Mr. Zaucha if a variation had been granted for the fence's location. Mr.
Zaucha stated that a variance had been granted in 1985 for the fence location. Mr. Phillips
then asked Mr. Zaucha if a fence permit had been issued for the fence replacement. Mr.
Zaucha responded by stating that there has been a fence permit issued. Mr. Phillips then
assured Mr. Contreras that each zoning variation request is reviewed on an individual
basis and that he understood Mr. Contrary's concerns. Mr. Phillips asked Mr. Zaucha if
he had any further comment. Mr. Zaucha responded by reminding the Board that the
relevant issue pertained to the pool installation and not the fence replacement.
At 7:25 Mr. Kaplan motioned for a vote which was seconded by Mrs, McClelland. The
vote was unanimously in favor of granting the variation. The meeting was adjourned by
Chairman Phillips at 7:30 p.m.
