Hauser T. Thompson C. McClelland G. Schumm J. Oliveto Absent: M. Coffman P. Kaplan R. Phillips Staff: J. Zaucha, Plan Reviewer Zoning Variation - Docket 97-5 Acting Chairman Tom Rodgers called the meeting to order at 7:00 p.m. and summarized the legal notice for the hearing. Petitioner Mrs. Christina Toth was sworn in and asked to state her case. Mrs. Toth stated that she has resided at 35 East Shelley for approximately 18 years and that the shed and concrete slab existed for at least that long. Mrs. Toth explained that it would be a financial hardship to relocate and construct a new foundation. Mr. Rodgers asked what type of shed would be constructed. Mrs. Toth replied that it would be a metal shed. Mrs. McClelland asked if there had ever been any complaints about the shed. Mrs. Toth responded by stating that there has never been any complaints about the shed. Mr. Thompson asked what prevents the shed from being relocated closer to the house. Mrs. Toth explained that the grade which slopes away from the house is too steep to relocate the shed closer to the house. Mr. Thompson asked Mrs. Toth if she knew the cost of installing a new foundation. Mrs. Toth responded by stating that the shed will cost approximately $200 and the foundation would probably cost at least $500. Mr. Oliveto asked if existing trees would cause any problems. Mrs. Toth replied, no. Mr. Rodgers asked Mr. Zaucha if the existing shed is nonconforming. Mr. Zaucha responded yes. Mr. Rodgers asked Mr. Zaucha if the Building Department had any more comments. Mr. Zaucha responded. no. At 7:13 p.m., Mr. Oliveto motioned for a vote which was seconded by Mrs. McClelland. The vote was 5 votes to 1 in favor of granting the variation. The meeting was adjourned by Acting Chairman Rodgers at 7:15 p.m. Respectfully submitted. mes S.
