Thompson T. Rodgers C. McClelland P. Kaplan J. Oliveto G. Schumm Absent: M. Coffman Staff: J. Zaucha, Plan Reviewer Zoning Variation - Docket 97-6 Chairman Robert Phillips called the meeting to order at 7:00 a.m. and summarized the legal notice for the hearing. Petitioner Mrs. Kimberly Meier was sworn in and asked to state her case. Mrs. Meier explained that she and her husband currently have a 9 month old child and are planning to have another child; creating the need for more storage space. Mrs. Meier also stated that having two vehicles necessitates the two car garage. At 7:05 p.m. a fire detection system initiated an alarm which caused the evacuation of the building. At 7:10 p.m. the meeting was resumed with Mrs. Meier stating her case. Mrs. Meier explained that locating the garage closer to the house would possibly lower the property value and create a visibility problem when pulling in and out of the driveway. Mrs. Meier stated that it would be more safe with the garage located closer to the property line because there would be increased visibility to see children whom may be present. Mrs. Meier also explained that from a financial standpoint,the proposed garage is the most feasible solution to their problem. Mrs. Meier also stated that newly created storage space in the garage would be used to store their children toys, lawn chairs, garbage cans and would eliminate the need for their existing storage shed. Mrs. Meiers stated that her neighbors have no objections to the proposal and that a notarized written statement to that effect was submitted to the Zoning Board. Mr. Hauser asked Mrs. Meier if she though locating the garage further away from the side property lien would greatly inconvenience her in maneuvering in and out of the driveway. Mrs. Meier answered, yes. Mr. Hauser asked what would be done with the remaining property between he garage and the property line. Meier Meier said that they would place stone in those areas. Mr. Hauser asked what type of vehicles Mr. & Mrs. Meiers drive. Mrs. Meier stated that they own a Nissan Pathfinder and a Honda Accord. Mr. Kaplan asked if the Meiers would be installing a fence along their side property line; extending to the rear property line. Mrs. Meier responded, no. Mr. Thompson asked if the Meiers currently only have a single car garage. Mrs. Meier answered.,yes. Mr. Thompson then asked Mrs. Meier if she felt having a two car garage was a necessity. Mrs. Meier answered, yes. Mrs. McClelland asked Mr. Zaucha if the Building & Engineering Departments had any concerns or recommendations. Mr. Zaucha stated that the Engineering Department had no objections to the driveway and garage installation and that there are no recommendations. Mrs. McClelland stated that she has safety concerns with regards to the narrow driveway. Mrs. Meier replied by stating that she is aware of possible hazards and that precautions would be taken to insure the safety of pedestrians. Mrs. McClelland asked if the Meiers considered the cost of building an addition to the back of their house while maintaining a single car garage. Mrs. Meier responded by stating that those alternatives were investigated and were found to be too expensive. Mr. Oliveto asked if the driveway in front of the existing garage would be removed. Mrs. Meier answered, yes. Mr. Oliveto asked if the four(4') foot easement encroachment would cause any problems with utilities. Mrs. Meier stated that the only problem is that their existing electrical service needs to be relocated. Mr. Rodgers asked how drainage would be directed. Mrs. Meier explained that drainage would be directed around the garage. Mr. Rodgers asked if drainage tiles would be installed. Mrs. Meier was uncertain but stated that her contractor would be addressing the issue. Mr. Phillips asked Mr. Zaucha how much ground coverage would be utilized in constructing the garage. Mr. Zaucha stated that approximately 31.23%of the required rear yard will be taken-up by the proposed garage. At 7:40 p.m. Mr. Kaplan motioned a vote to grant the variation. Mr. Hauser seconded the motion and a vote was taken. The vote was 5 to 2 in favor of granting the variation. At 7:44 the meeting was adjourned. Respectfully submitted Yames S.
