Zoning Variation - Docket 98-9
Chairman Robert Phillips called the meeting to order at 7: 00 p.m.
and read the legal notice. The petitioners Mr. and Mrs. Robert
Kimber were sworn in and asked to present their case.
Mrs. Kimber indicated that a variance had been previously granted
12 years ago for the existing deck. Mrs. Kimber explained that the
deck was originally needed to allow enough room for her mother-in-
law's wheel chair. Mrs. Kimber stated that they would now like to
enclose the deck because of her alergies.
Mr. Schumm asked Mrs. Kimber if the neighbors have any concerns.
Mrs. Kimber responded that there have been no negative comments
made by her neighbors. Mrs. Kimber did however indicate that one
of her neighbors originally misinterpreted what the variance was
for, and that after explaining it to the person, they did not have
any objections to the variance.
Mrs. McClelland asked for clarification on how the structure was to
be constructed. A representative from Back Yard Enclosures
proceeded to explain the basic structural features of the
enclosure. At that time, Mr. Penley pointed out that what was
being described by the contractor did not match what was shown on
plans submitted to the ZBA. Mr. Penley identified that the
submitted plans for approval reflect a flat shed-type roof, and
what was being described by the contractor was a gable style roof.
At that time, the petitioners and the contractor explained that a
gable style roof is being proposed and that plans submitted to the
ZBA reflecting a flat roof are not accurate.

Mr. Hauser asked if future construction of an enclosure on the deck
was discussed during proceedings for the original deck variation.
Mrs. Kimber stated that although she did not anticipate
construction of an enclosure at that time, the Board did recommend
that the deck be reinforced to allow for future construction of an
enclosure.
Mr. Oliveto asked if the deck would be sufficient to support the
enclosure. The contractor indicated that it is common to construct
this type of light weight enclosure on wood framed decks supported
by concrete piers.
Mr. Franke asked if there mould be any heat provided to the
enclosure. Mrs. Kimber responded, no.
Mr. Zaucha was asked if the Building and Engineering Departments
have any concerns. Mr. Zaucha had no comments regarding zoning
issues, but did indicate that .if the deck needed to be structurally
reinforced to support_ the enclosure, the contractor would be
required to do so.
At 7:19 Mr. Shumm motioned to grant the variance which was seconded
by Mr. Franke. A vote was taken which was unanimously in favor of
granting the variance. The meeting was adjourned at 7:21 p.m.
