Zoning Variation - Docket #99--1
Acting Chairman Paul Kaplan called the meeting to order at
7:00 p.m. and summarized the legal notice for the hearing.
Petitioner, Mr. Gary Williams was sworn in and asked by Mr. Kaplan
to state his case.
Mr. Williams explained that he is a carpenter and needs the garage
for increased storage space and to allow for both his and his
wife's vehicles to be parked inside. Mr. Williams further explained
that he intends to make several improvements to the property,
including the conversion of an existing attached garage into living
space. Mr. Williams stated that if he could not build the detached
garage, he would not make any improvements to the property and
would probably look for another house.
Mr. Zaucha was asked if a different Zoning Ordinance was in effect
at the time the home was constructed. Mr. Zaucha indicated that a
different Zoning Ordinance was in effect at the time the
subdivision was originally laid out.
Mr. Penley indicated he felt the location would be "o.k. " because
it lines up with the existing house. Mr. Oliveto asked if the
garage was for one or two vehicles. Mr. Williams indicated it
would be for two vehicles. Mr. . Hauser asked if the garage would
line up with the neighboring house. Mr. Williams indicated the
proposed garage would line up with the neighbor's house. Mr.
Franke asked if Mr. Williams 's neighbor was aware of his plans and
if there was any objections. Mr. Williams indicated that his
neighbor is aware and that he has not voiced any objections.

Mr. Kaplan asked Mr. Zaucha if the Building Department has any
objections. Mr. Zaucha stated that although the Building &
Engineering Departments do not have a recommendation for the Board,
clarification was needed on certain points. Mr. Zaucha informed
the Board that the neighboring property at 690 Grosvener Lane is
set back at least 25 feet from the front property line and that the
garage which is being proposed, 18 feet from the property line,
would stick out past the front of the neighbor's house. Mr. Zaucha
further explained that the intent of the current Zoning Ordinance
as it pertains to corner lots is to specifically prevent this from
occurring. Mr. Zaucha also noted that the detached garage located
across the street at 260 Victoria Lane is set back 25 feet from the
property line and is in compliance.
Mr. Kaplan asked if there were any comments to be heard from the
public. A resident of 693 Middleburry, Ms. Marie French indicated
that she had been out of town and had just received the public
notice in the mail . Ms. French had concerns of how the garage
would affect her property value and asked for clarification on the
proposal . The proposal was explained more clearly to Ms. French.
Mr. Penley explained that the purpose of the hearing was to
determine setback requirements for the garage and not to decide
whether nor not the garage could be built. Mr. Penley stressed
that the resident is within his rights to construct the garage with
a 25-foot setback.
At 7:22 Mr. Kaplan asked for a motion. Mr. Penley motioned to
grant the variation which was seconded by Mr. Oliveto. A vote took
place with 5 votes in favor of granting the variation and one vote
by Mr. Hauser to deny the variation. The meeting was adjourned by
acting Chairman Paul Kaplan at 7:25 p.m.
