Kaplan T. Rodgers G. Schumm J. Oliveto Staff: S. Trudan, Asst. Director of CD Zoning Variation - Docket 99-2, 933 Jackson Circle The meeting was called to order by Chairman Phillips at 7:30 PM and the legal notice was read aloud. The petitioner, Mr. John Rogers explained that approximately four years ago Nerge Road was widened and raised approximately four feet. The result negated the effectiveness of his existing six- foot high fence in terms of its ability to screen the view of his home and yard from the roadway, and its ability to block out traffic noise. He explained that the existing fence is approximately twenty years old and is due to be replaced. Several board members explained that they had visited the property and agreed that the existing fence provided no effective screening or privacy. It was also pointed out that there was a swimming pool in the petitioner's backyard, and that the entire length of fence in this area along Nerge Road belongs to the petitioner. Mr. Trudan explained that historically the Village did not permit fences that were taller than six feet unless they were used as screening, when screening was required by the ordinance. The petitioner explained that the fencing located along Nerge Road would be eight feet in height with the fencing located on the side property lines being six feet in height. A motion was made by Mr. Kaplan to grant the variation and seconded by Mr. Rodgers. The motion was approved by unanimous vote. The meeting was adjourned at 7:12 PM.
