Kaplan G. Schumm J. Franke Staff: J. Zaucha, Plan Reviewer Zoning Variation - Docket X99-3 Chairman Phillips called the meeting to order at 7:00 PM and swore in the petitioner, Anthony Zaremba. Chairman Phillips then read the legal notice and requested that Mr. Zaremba state his case. Mr. Zaremba stated that he has a problem with standing water in his rear yard. He explained that this is due to a combination of surrounding grades, bushes, flowerbeds and sump pumps discharging into the rear yards along his block. Mr. Zaremba stated that a zoning variation would allow him to construct a shed at the highest elevated point in his yard. Mr. Zaremba also indicated that placing the shed six feet (6'-0") from the side lot line would cause the shed to obstruct his kitchen window. Mr. Zaremba stated that he is willing to locate the shed two feet (2'-0") from the side lot line, but if he located the shed further from the side lot line, he would be forced to relocate an underground cable television line which runs across his property. Chairman Phillips then asked each Board member if there was any questions or comments. Mr. Penley indicated that to improve drainage, the subject property should be re-graded. Mr. Zaremba responded by indicating that he could not raise the elevation of his yard. It was then suggested that Mr. Zaremba contact the Village 's Engineering Department. Page 2 Mr. Franke commented that he wanted it to be clear that the shed should be located at least two feet (2'-0') from the side lot line. Mr. Kaplan asked Mr. Zaremba if there had been any negative comments made by his neighbors. Mr. Zaremba stated that his surrounding neighbors have indicated that replacing the old shed with a new shed would be an improvement. Mr. Kaplan also asked if a concrete slab would be installed. Mr. Zaremba indicated that due to animal problems, he intended to install a concrete slab. At 7:15 PM, Mr. Kaplan motioned to grant the variation, provided the shed is installed a minimum of two feet (2'-0") from the side lot line. A vote was taken unanimously in favor of granting the variance. The meeting was adjourned at 7:16 PM. Respectfully submitted, ames S.
