Zaucha, Plan Reviewer Zoning Variation - Docket #99-8 Chairman Robert Phillips called the meeting to order at 8:20 PM and read the legal notice. The petitioner, Mr. Brian Schulz was sworn in and asked to present his case. Mr. Schulz explained that he has lived in the Village for 14 years and now has triplets, resulting in the need for additional storage space. Mr. Phillips asked if the proposed 3'-9" distance to the side property line will be to the roof overhang or to the garage wall . Mr. Schulz indicated that the proposed dimension would be measured from the property line to the edge of the concrete foundation. Mr. Penley asked how much of a roof overhang there would be. Mr. Schulz did not provide a specific dimension, but did indicate that it could possibly be 12 inches. Mr. Schulz explained that the new roof for the addition would be a gable type, which would then tie into the existing roof at a right angle. Mr. Schulz indicated that this type of roof would allow a minimal roof overhang along the side property line. Mr. Hauser asked if the remaining side yard would be improved. Mr. Schulz indicated that he will install a brick paver sidewalk along the side of his house which would lead to a brick paver patio located in the rear yard. Mr. Hauser asked Mr. Schulz if his neighbor had any comments. Mr. Schulz responded that his neighbor is in the meeting room. At that time, Mr. Phillips indicated that the public would be given the opportunity to speak after the Board was finished asking questions. Mr. Kaplan asked if the driveway would be widened. Mr. Schulz indicated that the driveway would not be widened, and that the proposed addition was strictly to provide more storage space. Page 2 Mr. Phillips asked the public if there were any comments. Mr. Tom Jardine of 581 Dogwood Trail told the Board that the proposed addition would look fine and that it would not be a hindrance. Mr. Donald Tooman of 542 Dogwood Trail expressed his concern that approval of the variation may start precedence for future sideyard encroachments. The Board reassured Mr. Tooman that each case is reviewed on an individual basis, and that surrounding neighbors always have the right to voice their opinions and concerns. Mr. Alan Granskog of 690 Clearmont Drive told the Board that variations should not be granted based on what neighbors think looks nice, but what is best for the Village. Mr. Granskog explained that neighbors constantly change and that what may be acceptable to one person may be unacceptable to future residents of the area. Mr. Penley responded by stating that the Board makes its decisions based on the best available information. It was also expressed by Mr. Phillips that what neighboring residents think is valid in the decision making process. Mr. Phillips asked if Mr. Zaucha had any comments. Mr. Zaucha indicated that the Engineering Department had concerns that proper drainage continue to be directed to the front yard and not in the neighbors side yard. Mr. Zaucha informed the Board that the gable roof being proposed would have two valleys which would collect rainwater and need proper drainage. Mr. Zaucha indicated that these issues would be addressed during plan review. At 8:36, Mr. Schumm motioned to grant the variation which was seconded by Mr. Kaplan. A vote was taken which was 6 to 1 in favor of granting the variance. Mr. Rodgers voted to not grant the variation. Mr. Phillips instructed Mr. Marceau to call the Village Clerk to find out when the variation request would be placed on the Village Board's agenda. The meeting was adjourned at 8:40 PM.
