Rodgers G. Schumm J. Franke J. Walz Staff: J. Zaucha, Plan Reviewer Zoning Variation - Docket #99-9 Acting Chairman Paul Kaplan called the meeting to order at 7: 00 p.m. and summarized the legal notice for the hearing. Petitioner, Mr. Robert Hlavana was sworn in and asked by Mr. Kaplan to state his case. Mr. Hlavana stated that he and his girlfriend, Patricia Kummer are co-owners of the house, which they would like to provide additional living space along with a nice front porch. Mr. Hlavana explained that given the existing structure's proximity to the 25 foot setback line, a variation is necessary to provide enough space for a usable porch. Mr. Penley voiced concern over the stairs which will extend beyond the front porch. Mr. Hlavana responded by indicating that plans for the stairs have been revised to reduce the stairs to only one or two steps. Mr. Schumm asked if portions of the porch would encroach more than the requested 4 ' -1" . Mr. Hlavana responded, no. Mr. Hauser asked if the second floor sitting room would encroach beyond the front porch roof line. Mr. Hlavana responded, no. Mr. Franke asked if a new detached garage would be constructed to replace the existing attached garage. Mr. Hlavana responded, yes. Page 2 Mr. Oliveto asked if the existing foundation for the attached garage would be sufficient for conversion into living space. Mr. Zaucha indicated that the adequacy of the foundation would be addressed in plan review. Mr. Zaucha advised the petitioner to confirm the feasibility of constructing a detached garage on the property, prior to converting the existing garage. At 7:12, Mr. Rodgers motioned to grant the variation with the allowable encroachment increased to 5' -1" . Mr. Zaucha advised the Board that the encroachment of a couple concrete steps did not warrant the increase to 5' -1" . Mr. Rodgers amended his motion to grant the variation with a 4 ' -1" encroachment, which was seconded by Mr. Oliveto. A vote was taken which was unanimously in favor of granting the variance. The meeting was adjourned by acting Chairman Paul Kaplan at 7:13 p.m. Respectfully submitted, kames S.
