Rodgers G. Schumm J. Franke J. Walz Staff: J. Zaucha, Plan Reviewer Zoning Variation - Docket #99-10 Acting Chairman Paul Kaplan called the meeting to order at 7:30 p.m. and summarized the legal notice for the hearing. Petitioner, Mr. Steve Schrager was sworn in and asked by Mr. Kaplan to state his case. Mr. Schrager explained that he would like the proposed garage to be located even with the edge of his house to provided additional yard space behind the garage. Mr. Kaplan asked if the existing garage would be converted into living space. Mr. Schrager indicated that eventually the attached garage would be converted into living space. Mr. Schrager was asked if the existing driveway would be removed. Mr. Schrager responded, possibly. Mr. Schumm asked if an existing tree located on the property's south side would be removed. Mr. Schrager indicated the tree would be removed. Mr. Penley noted the proposed garage is uniquely large in size. Mr. Schrager explained that he owns a remodeling company and needs the space for his large work (dump) truck, snow plow and his wife's vehicle. Mr. Penley pointed out that if vehicles would be parked on the driveway, they would obstruct the public sidewalk. Mr. Schrager responded by indicating that his vehicles would be parked in the garage. Mr. Shrager explained that his work truck has been broken into several times, and that he needs the garage to provide safe storage of his truck and tools. Page 2 Mr. Kaplan asked Mr. Zaucha for comment. Mr. Zaucha stated that parking spaces required by the Zoning Ordinance would be located in the detached garage. Mr. Zaucha indicated that the existing driveway was not required to be removed and stated that Mr. Schrager would be permitted to park his vehicles on the proposed driveway, as long as they are routinely driven and not kept there simply for storage. Mr. Franke asked if the garage would be as tall as the house. Mr. Schrager indicated that the garage would not be as tall as the house. Mr. Rodgers asked if the existing shed would remain. Mr. Schrager indicated that the shed would remain. Mr. Kaplan asked Mr. Schrager how many vehicles he owns. Mr. Schrager responded, three (3) . Mr. Kaplan asked Mr. Zaucha for comments. Mr. Zaucha informed the Board that the Village prohibits home occupations from operating out of residences. Mr. Zaucha referred the Board to the Zoning Ordinance which defines home occupation, and expressed his concern that the petitioner may possibly violate the ordinance by devoting too much floor space for the operation of his business. Mr. Walz asked if Mr. Schrager's dump truck would be included in determining how much area is being devoted to his business. Mr. Zaucha indicated that it probably would, but that it would be an interpretation to be made by the Director of Community Development. Mr. Zaucha also indicated that home occupations are normally handled on a complaint basis . Mr. Schrager was asked if he would be operating a home occupation from his residence. Mr. Schrager assured the Board that he would not be operating a home occupation. At 7:45, Mr. Franke motioned to grant the variation which was seconded by Mr. Penley. A vote took place which was unanimously in favor of granting the variance. The meeting was adjourned by acting Chairman Paul Kaplan at 7:46 p.m. Page 3 Respectfully submitted, James S.
