Penley E. Hauser J. Oliveto T. Rodgers G. Schumm J. Franke Staff: J. Zaucha, Plan Reviewer Zoning Variation - Docket #99-14 Chairman Phillips called the meeting to order at 7:00 P.M. and summarized the legal notice for the hearing. Petitioner, Mrs. Mary Ann Christenson was sworn in and asked by Mr. Phillips to state her case. Mrs. Christenson explained that the existing garage at 700 Maple Court had already been converted into living space prior to their purchasing the home 22 years ago. Mrs. Christenson stated that she and her husband applied for a Building Permit to simply convert the small remaining garage space into habitable space. She indicated that her permit was denied because of inadequate parking. Mrs. Christenson stated that she contacted the village to inquire about the problem and was told that her vehicles could not be parked across the sidewalk. To address the parking requirements, Mrs. Christenson had her contractor obtain a permit to widen the driveway and a Building Permit was subsequently issued. Mrs. Christenson continued to explain that when her son moved out of the house, there was adequate room to park their two remaining cars in the driveway. She explained that since her vehicles do not obstruct the sidewalk, she thought she did not need to widen the driveway. Mr. Phillips informed Mrs. Christenson that if a variation were approved, it would remain in effect regardless of who owns the property. Mr. Phillips asked Mr. Zaucha where required parking spaces are measured. Mr. Zaucha indicated that parking spaces are Page 2 measured from the front property line, which is typically within 12 inches of the sidewalk, to the front of the garage. Mr. Oliveto asked if two cars were able to fit on the driveway without blocking the sidewalk. Mrs. Christenson responded, yes. Mr. Oliveto indicated that there could be problems in the future with the next owner of the property. Mr. Schumm commented that the letter submitted by the contractor indicates that he informed Mrs. Christenson of the parking requirements. Mrs. Christenson responded by indicating that a person from the Village told her that she could simply not block the sidewalk. Mr. Schumm than commented that a letter sent to Mrs. Christenson from the Village President indicates the Village has no record of a partial garage conversion ever being performed. In response, Mrs. Christenson offered copies of an original real estate ad, which proves the partial garage conversion existed prior to the purchase of the property. Mr. Hauser asked Mrs. Christenson if there were other homes on her block that do not have functional garages. Mrs. Christenson indicated that there are several garages that are currently used for storage and purposes other than parking vehicles. Mr. Franke asked if the garage was considered to be a parking space. Mr. Zaucha responded, yes. Mr. Franke asked if Mrs. Christenson agreed to expand the driveway at the time that the Building Permit was issued. Mrs. Christenson responded, yes. Mr. Penley stated that Mrs. Christenson's problem is that she made an agreement with the Village to widen the driveway and she is now trying to get out of it. Mr. Penley stated he is unwilling to negate that agreement. Mr. Phillips asked Mr. Zaucha if he had any comments. Mr. Zaucha made a few clarifications to the Board concerning the location of property lines and building setbacks. At 7:33 P.M. , Mr. Penley motioned to deny the variance request which was seconded by Mr. Schumm. A vote was taken which was unanimously in favor of denying the variance. The petitioner was advised to work with the Engineering Department to find a way to expand the driveway without adversely effecting an existing tree. The meeting was adjourned at 7:35 P.M.
