Oliveto T. Rodgers G. Schumm J. Franke J. Walz Staff: J. Zaucha, Plan Reviewer Zoning Variation - Docket #99-16 Chairman Phillips called the meeting to order at 7:47 P.M. and summarized the legal notice for the hearing. Petitioner, Mr. John Nitti and his building contractor, Mr. Carl Bongiovanni were sworn in and asked by Mr. Phillips to state their case. Mr. Bongiovanni described characteristics of Circle Bay which make it a desirable place to live. Mr. Bongiovanni explained that Mr. Nitti needs additional space for his family, and expressed the Nitti family's strong desire to remain residents in the Circle Bay development. Mr. Bongiovanni indicated that views from surrounding properties would not be obstructed and that property values would increase as a result of the proposed improvements. Mr. Oliveto asked how much floor space could be taken off the addition in order to meet code. Mr. Bongiovanni indicated that it would need a significant cutback. Mr. Oliveto asked if views would be obstructed. Mr. Bongiovanni responded, no. Mr. Schumm asked how deep the proposed addition would be. Mr. Bongiovanni responded, 15 feet. Mr. Schumm asked what the petitioner's hardship is. Mr. Bongiovanni indicated that the Nitti family has increased in size, requiring additional living space. Mr. Schumm asked if the basement would be finished, Mr. Bongiovanni responded, yes. Mr. Hauser asked how many members are in the Nitti family. Mr. Bongiovanni responded 5 members with 2 dogs. Mr. Hauser asked how much square footage would need to be eliminated to meet code. Mr. Zaucha indicated that exclusive of the proposed finished basement, 697. 6 square feet of floor space would need to be eliminated. Page 2 Mr. Franke asked how much floor space the existing house has. Mr. Zaucha indicated that according to the architect's figures, the existing house has 3, 263 square feet, exclusive of the basement. Mr. Rodgers asked for clarification of the hardship. Mr. Bongiovanni indicated that if the addition is not approved, the Nitti 's might be forced to move. Mr. Nitti expressed his desire to continue living in Circle Bay and again explained his family's need for the additional space. Mr. Kaplan asked if there have been other additions built in Circle Bay. Mr. Bongiovanni responded, several . Mr. Kaplan asked if any of the other additions needed variances. Mr. Bongiovanni did not believe so. Mr. Kaplan asked how the Circle Bay Homeowners Association approves home improvements. Mrs. Barb Lahtinen, the Association 's President, explained that surveys are mailed out to members and plans are reviewed with a vote being taken. Mr. Kaplan asked if the patio would be extended. Mr. Nitti responded, yes. Mr. Phillips asked how many members are on the Association 's board. Mrs. Lahtinen responded, seven. Mr. Phillips asked what the vote was. Mrs. Lahtinen indicated the vote was initially tied, but a second vote was 4 to 2 in favor of approval . Mr. Phillips then read a letter submitted by Mr. & Mrs. Arthur Erickson (529 Montego Drive) which expressed their opposition to the variance being approved. Mr. Phillips asked for comments from the public. The following residents each expressed their thoughts that the variance should be approved because of the positive effects it would have on surrounding property values: Mrs. Mary Jo Harrold (592 Montego Drive) , Mr. Patrick Briggs (1215 Montego Court) and Mr. Alan Barone (552 Montego Drive) . Mr. Kaplan motioned to approve the variation, which was seconded by Mr. Walz. A vote was taken which was 6 to 1 in favor of approving the variance. Mr. Hauser voted to deny the variance. The meeting was adjourned at 8:26 P.M. As requested by Zoning Board member Mr. Ed Hauser, it is noted for the record, that if both existing and proposed basements will be finished as habitable living space and subsequently included in the floor area ratio (F.A.R. ) , the proposed F.A.R. will increase from . 49 to approximately . 66.
