Chairman
"iChairman Phillips called the meeting to order at 7 :00 P.M. and
summarized the legal notice i-or the hearing. Petitioners, Mr. &
Mrs. Patrick Ryan, along with their building contractor, Mr.
Michael Stelzer were sworn in and asked by Mr. Phillips to state
their case.
Mr. Ryan explained the addition of children to their family, along
with a large dog, creates a need for additional living space.
Mr. Hauser asked Mr. Zaucha sf there were any covenants approved
during the original development of the subdivision, placing a limit
on the amount of expansion permitted on homes located within the
subdivision. Mr. Zaucha indicated that he did not have that
information readily available but would have it available for the
Village Board.
Mr. Schumm asked if it is possible to reconfigure the addition to
fit within the allowable setbacks. Mr. Stelzer indicated that it
is not possible due to the existing interior layout of the house.
Mr. Walz asked if the petitioner had spoken with surrounding
neighbors regarding the proposal . Mr. Ryan indicated the neighbors
he had spoken with did not have any reservations concerning his
proposal .
During a discussion of how the structure would look, it was
determined that an additional two foot (2' -0" ) encroachment into
the required rear yard would be required to accommodate a proposed
fireplace. The two foot fireplace extension is not reflected in the
site plan submitted for consideration. With the two foot fireplace
extension, the total required rear yard encroachment is increased
to 8. 03 feet .

Mr. Hauser asked if the property experiences drainage problems.
Mr. Ryan responded, no. Mr. Phillips asked for comments from the
Department of Engineering & Community Development. Mr. Zaucha
indicated that there are no significant concerns other than
maintaining proper drainage. Mr. Zaucha stated that fill is
typically not permitted to be placed in drainage easements. Mr.
Zaucha explained that given the steeply sloped rear yard, and the
close proximity of the addition to the rear drainage easement,
grades adjacent to the addition would need to be established while
not affecting the drainage easement.
At 7:28 P.M. , Mr. Rodgers motioned to approve the 8. 03-foot rear
yard encroachment for the proposed room addition. Mr. Hauser
seconded the motion. A vote was taken which was unanimously in
favor of approving the variance. The petitioner was advised to
contact the Village Clerk's office to confirm that they would be on
the next Village Board agenda. The meeting was adjourned at 7:30
P.M.

hearing for Docket #00-1 . You will notice that the proposed rear NN
yard encroachment has been increased from 6. 03 feet to 8. 03
feet . The Zoning Board voted to approve the variance with the
increased encroachment of 8. 03 feet. Please make whatever notes
are necessary for the record and for the upcoming Village Board
meeting.
