Zaucha, Plan Reviewer Zoning Variation: Docket #00-5 - 1450 JAMES WAY Acting Chairman Paul Kaplan called the meeting to order at 7:00 P.M. and summarized the legal notice for the hearing. Petitioner, Mr. Walter Janusch was sworn .in and asked to state his case. Mr. Janusch explained that he wishes to erect a fence to allow space for his large dog, which currently is kept on a chain. Mr. Janusch indicated that he is willing to locate sections #3 and #4 of the fence, as shown on the proposed site plan, as close as possible to bushes which exist along the northeast side of the subject property. Mr. Janusch indicated the fence would be located on the side of the bushes facing the neighbors. Mr. Hauser asked what type of fence is being proposed. Mr. Janusch responded a five-foot tall wood picket fence. Mr. Hauser asked if any neighbors have expressed concern over the fence being installed. Mr. Janusch responded, no. Mr. Oliveto expressed concern over the fence being located too close to the neighboring property. Mr. Janusch indicated his neighbor has shown no objections to the fence being installed. Mr. Steve Andolino of 1444 James Court indicated he has no problems with the fence, provided it .is screened from view with bushes. Mrs. Barbara Marquez of 1436 Hodlmair Lane asked if an approval would set a precedent for future variances. Mr. Kaplan explained that each variation request is reviewed on an individual basis. Mr. Robert Benak of 1424 Hodlmair asked to see the proposed site plan, which was then made available. Page 2 Mr. Hauser asked to confirm whether or not the fence would be on the inside or outside of the existing bushes. Mr. Janusch indicated the fence would be on the outside of the bushes. Further discussion continued of possible configurations and compromises on the part of the petitioner. Mr. Kaplan then announced that the meeting would be continued to a later date. The petitioner was instructed to explore available options and return with a clearly defined proposal for consideration. The meeting was adjourned at 7:40 P.M. Respectfully submitted, James S.
