CONTINUATION OF MARCH 16TH HEARING
Chairman Phillips called the meeting to order at 7: 00 P.M. and
summarized the legal notice for the hearing. Petitioner, Mr. Walter
Janusch was sworn in and asked! to state his case.
Having further reviewed available options, Mr. Janusch explained he
is willing to reduce the proposed fence height to four (4) feet and
locate the fence on the inside (house side) of bushes which exist
along the north property line. Mr. Janusch also indicated that the
intersection of fence sections #3 and #4 would be relocated to be
a minimum of twelve (12) feet from the northeast property line.
Mr. Phillips asked to confirm whether or not the fence would be on
the inside or outside of the existing bushes. Mr. Janusch indicated
the fence would be on the inside (house side) of the bushes.
Mr. Franke asked to confirm the proposed fence height. Mr. Janusch
indicated the proposed fence height is now four (4) feet.
Mr. Schumm asked to confirm whether or not existing bushes would be
capable of screening the fence from view to neighbors. Mr. Janusch
indicated the existing bushes are approximately eight feet tall .
At 7:50, Mr. Schumm motioned to grant the amended variance request
which was then seconded by Mr. Kaplan. The amended variance request
consists of the following: Install a fence on the inside of
existing bushes parallel to the north property line; while
maintaining a minimum distance of twelve feet (12' -0" ) from the
northeast property line, as reflected on the amended site plan
submitted to the Zoning Board on April 6"', 2000. The fence shall
not exceed a height of four fee=t (4 ' -0" ) above surrounding grade.

A vote was taken which was unanimously in favor of approving the
amended variance request. The petitioner was advised to contact the
Village Clerk's office to confirm that they would be on the next
Village Board agenda. The meeting was adjourned at 8:10 P.M.
