Zoning Variation: Docket #00-6 - 549 OAK STREET
CONTINUED FROM APRIL 6TH, 2000
Chairman Phillips called the meeting to order at 7:30 P.M. and
summarized the legal notice for the hearing. Mr. Jason & Jennifer
Jonas were sworn in and asked to state their case.
Mr. Jonas explained the variance is needed to provide a safe means
for vehicles to maneuver into the garage while maintaining open
space in the rear yard.
Mr. Schumm asked if permission has been obtained to encroach into
the easement. Mr. Jonas responded, yes. Mr. Schumm asked if
permission has been obtained to remove the parkway tree. Mr. Jonas
responded, yes. Mr. Schumm asked how the property along the side
of the garage will be maintained. Mr. Jonas indicated that he
plans to install decorative gravel along the side of the garage.
Mr. Hauser asked if the garage could be rotated in a similar
fashion as his neighbors. Mr. Jonas indicated that his neighbor
has a smaller garage, and configuring the garage in that manner,
would take up too much space :in his yard.
Mr. Franke asked if the tree labeled " D" on the site plan could
be removed. Mr. Jonas responded, yes but not necessary. Mr. Walz
expressed a concern for not enough space being provided along the
side property line for maintenance. Mr. Jonas indicated that he
will install decorative rocks or whatever else the Board would
like.

Mr. Phillips asked if the existing fence along the north property
line could be relocated closer to the property line, to provide
additional space between the? garage and the fence. Mr. Jonas
responded, yes.
Mr. Franke indicated that in addition to the fence being relocated
to the property line, he would prefer that the garage be located no
closer than four (4) feet to the side property line. Mr. Phillips
asked if there were any objections to locating the garage four (4)
feet from the side property line. Mr. Jonas indicated he is willing
to accept the compromise.
At 7:50, Mr. Penley motioned to grant an amended variance request
to allow the garage to be constructed no closer than four (4) feet
to the side property line, provided the existing fence is relocated
as close as possible to the side (north) property line. Mr. Oliveto
seconded the motion.
A vote took place which was unanimously in favor of granting the
amended variance. The petitioner was advised to contact the Village
Clerk's office to confirm that they would be on the April 251h
Village Board agenda. The meeting was adjourned at 7:52 P.M.
Respectfully submitted,
