Chairman Phillips called the meeting to order at 7: 00 P.M. and
summarized the legal notice for the hearing. Petitioner, Mr. David
Prill was sworn in and asked to state his case.
Mr. Prill stated that due to the odd shape of his front lot line,
the required side yard setback is 9. 5 feet. Mr. Prill explained
that this is established by measuring along the curvature of the
front lot line. Mr. Prill requested that instead of measuring the
lineal footage of the front lot line, the Zoning Board consider
establishing the side yard setback by measuring the actual lot
width. Mr. Prill indicated that since the lot width is 79 feet at
the front lot line, the side yard setback would be 8 feet.
Mr. Penley asked if the variance request included the roof
overhang. Mr. Prill indicated that he believed so, but was not
certain. Mr. Walz asked if the driveway would be widened. Mr.
Prill indicated the driveway would be widened, but not the drive
apron. Mr. Oliveto asked how the garage would be used. Mr. Frill
indicated the garage would be used for a car and additional storage
space.
Mr. Hauser asked if the garage would cause drainage problems. Mr.
Zaucha stated that roof gutters will collect and direct water to
the driveway, which will be sloped in a manner not to cause
drainage problems.

Mr. Robert DiDomenico of 578 Jersey Lane asked if a variance
approval would set a precedence for future garage encroachments
being approved. Mr. DiDomenico was assured by Board members that
each variance request is individually reviewed upon it's own merit.
Mr. Zaucha was asked if there were any comments from the
Engineering Department. Mr. Zaucha suggested that architectural
plans be double checked to confirm the variance being requested
includes the roof overhang. A review of plans revealed the
approximate 12 inch roof overhang was not included in the variance
request. After a brief discussion, the Zoning Board decided to
amend the variance request to allow for the roof overhang. The
amended side yard encroachment was set at two feet and 10 inches
(21 -10" ) .
At 7:27, Mr. Kaplan motioned to grant the amended variance request
to allow the construction of a garage addition which will encroach
approximately two feet and ten inches (2' -10" ) into the requried
side yard. The motion was seconded by Mr. Penley.
A vote was taken which was unanimously in favor of approving the
amended variance request. The petitioner was informed by Mr.
Phillips that the variance request would not be on the agenda for
the May 23rd Village Board meeting. The petitioner was advised to
contact the Village Clerk's office to confirm when the docket would
be on placed on the Board's agenda. The meeting was adjourned at
7:30 P.M.
