Kaplan J. Franke J. Walz Staff: J. Zaucha, Plan Reviewer Zoning Variation - 1820 BANGOR LANE - Docket #00-9 Chairman Phillips called the meeting to order at 7: 00 P.M. and summarized the legal notice for the hearing. Petitioners, Mr. & Mrs. Donald Kingsmill were sworn in and asked by Mr. Phillips to state their case. Mrs. Kingsmill explained it is desired to construct a fence around the outside of their existing landscaped berm so as to not reduce the size of the rear yard. Mr. Rodgers asked for clarification of whether or not the property was considered a corner lot. Mr. Zaucha explained that although the street does curve around the house, the property is not considered a corner lot and is not required to meet fence regulations as such. Mr. Zaucha explained the variance is for encroachment into the required front yard. Mr. Franke asked if it would be difficult to maintain the property outside the fence. Mr. Kingsmill responded, no. Mr. Franke indicated that he feels the fence will be too close to the sidewalk. Mr. Kaplan asked to confirm whether or not the fence would be located inside or outside the landscaped berm. Mr. Kingsmill indicated the fence would be located outside the berm. Mr. Kaplan asked if the neighbor located to the rear of the property voiced any concerns. Mr. Kingsmill indicated that the rear neighbor has no problem with the fence installation. Mr. Kaplan indicated that he feels the fence would be located too close to the sidewalk. Mr. Phillips indicated that he feels the fence will be located too close to the sidewalk and pointed out that he would prefer the fence be installed on the inside (house side) of the berm. Page 2 Several Board members made comments suggesting the landscaped berm fails to meet zoning requirements. Mr. Zaucha clarified to the Board that landscape restrictions for corner lots do not apply and that the current landscaping does meet zoning requirements. Mr. Walz suggested the fence be permitted to be installed outside the berm, provided a minimum distance of five feet (5' -0" ) be maintained from the property line. After a brief discussion, Mr. Walz motioned to approve the variance request, to construct a four foot (4 ' -0" ) tall picket fence=, which will encroach not more than fifteen feet (15' -0" ) into the required twenty foot (20' -0" ) front yard. At 7:32, vote was taken which was 4 to 1 in favor of approving the amended variance request. Mr.. Kaplan voted to not approve the variance request. The petitioner was advised to contact the Village Clerk's office to confirm that they would be on the next Village Board agenda. The meeting was adjourned at 7:35 P.M.
