Zoning Variation: 1163 CUNNINGHAM CIRCLE - DOCKET #00-12
Chairman Phillips called the meeting to order at 7:00 P.M.
Petitioners, Mr. & Mrs. Michael Jaszczuroski were sworn in and
asked by Mr. Phillips to state their case.
Mr. Jaszczuroski explained storage space is needed and the existing
driveway is too short to park two vehicles. Mr. Jaszczuroski also
indicated that the north end of the house is already located
approximately five (5) feet from the property line.
Mr. Schumm asked whether or not the 12 inch overhang was included
in the variance request. Mr. Jaszczuroski responded, no. Mr.
Schumm asked what would be done with the existing driveway and
garage. Mr. Jaszczuroski indicated the driveway would be removed
and replaced with sod, and the garage would be converted to living
space.
Mr. Hauser asked why the north end of the house was located five
feet from the property line. Mr. Zaucha explained that the house
was constructed prior to the zoning ordinance requiring an eight
(8) foot side yard setback.
Mr. Franke commented that grading along the south property line
will be required to be maintained to allow proper drainage. Mr.
Jaszczuroski agreed. Mr. Penley asked if the garage would obstruct
an existing crawl space vent. Mr. Jaszczuroski responded, no.

Mr. Phillips asked for comments from the public. Mr. & Mrs. Erik
White of 1165 Cunningham Circle stated they have no problems with
the request and that they feel the addition will increase property
values. Mrs. Carey Riley of 1.159 Cunningham Circle also indicated
that she has no objections to the request.
At 7:15, Mr. Penley motioned to approve the variance to allow a
three (3) foot side yard encroachment plus a twelve (12) inch roof
overhang. The motion was seconded by Mr. Kaplan. A vote was taken
which was unanimously in favor of approving the variance request.
The petitioner was advised several times to contact the Village
Clerk's office to confirm when they would be scheduled on the
Village Board's agenda. The meeting was adjourned at 7:20 P.M.
Respectfully submitted,
James S. Zaucha
