Zoning Variation - 940 Victoria Lane - Docket #00-13
Chairman Phillips called the meeting to order at 7:00 P.M. and
summarized the legal notice for the hearing. Petitioners, Mr. &
Mrs. Michael Cliff were sworn in and asked by Mr. Phillips to state
their case.
Mr. Cliff explained that if the garage were to be located as the
Zoning Ordinance requires, it would be too close to their existing
sun room and difficult for vehicles to maneuver. Mr. Cliff also
indicated that their home currently does not have a garage and that
the garage is needed for storage and to maintain the value of their
vehicles.
Mr. Franke asked if the original garage had been converted into
living space. Mr. Cliff responded, yes. Mr. Kaplan asked whether
or not Mr. Cliff had spoken with neighbors. Mr. Cliff responded,
yes. Mr. Kaplan asked if Mr. Cliff converted the garage to living
space. Mr. Cliff indicated that the garage had already been
converted when he purchased the house in 1995. Mr. Kaplan asked
where the garage roof would drain. Mr. Cliff indicated the garage
roof would drain to the drainage easement.
Mr. Oliveto asked how many trees would need to be removed. Mr.
Cliff indicated that one tree located on his private property would
need to be removed. Mr. Walz asked if the existing driveway would
be removed. Mr. Cliff responded, yes.

Mr. Penley indicated he was in favor of approving the variance, but
advised Mr. Cliff that encroaching into the utility easement places
himself at risk. Mr. Cliff was informed by Mr. Penley that the
utility companies have the right to remove structures which
obstruct utility upkeep in the easement, and that if utility
improvements are needed in the future, it could be disastrous for
his garage.
Mr. Rodgers asked where the existing air conditioner would be
relocated. Mr. Cliff indicated the air condition would be relocated
to the rear of the house. Mr. Phillips asked what would be done
with the existing shed. Mr. Cliff indicated the shed would be
removed.
Ms. Phillis Powers of 942 Victoria Lane, stated that she is in
favor of approving the variance. Mr. Phillips asked if the utility
companies had warned Mr. Cliff of possible problems with being
located in the easement. Mr. Cliff indicated that he was notified
in letters from the utility companies.
At 7:18, Mr. Kaplan motioned to approved the variance, which was
seconded by Mr. Walz. A vote was taken which was unanimously in
favor of approving the variance request. The petitioner was advised
to contact the Village Clerk's office to confirm that they would be
on the next Village Board agenda. The meeting was adjourned at 7:20
P.M.
