Rodgers P. Kaplan J. Franke J. Walz G. Schumm Staff: J. Zaucha, Plan Reviewer Zoning Variation: Docket #00-19 - 935 RICHMOND COURT Chairman Phillips called the meeting to order at 7: 00 P.M. and summarized the legal notice for the hearing. Mr. Emanuel Loiacono was sworn in and asked to state his case. Mr. Loiacono explained that he owns three expensive full size vehicles which he would like to maintain in the expanded garage. Mr. Loiacono also clarified that he is proposing a garage which would be 12 feet wide as opposed to the 14 foot width specified in the submitted site plan. Mr. Loiacono indicated that the 14 foot width dimension was a mistake and that the 12 foot width would not effect the variance being requested. Mr. Zaucha confirmed this by indicating that a 14 foot wide garage would have been within 1 foot of the property line, and 12 foot wide garage would be within 3 feet of the property line. Mr. Phillips read a letter submitted by Mrs. Wayne McNamara of 941 Richmond Court. The letter expressed Mrs. McNamara's negative feelings for the proposed garage. Mr. Franke asked if existing landscape timbers are located on the property line. Mr. Loiacono indicated the timbers are approximately 6 inches from the property line. Mr. Penley asked why a detached garage could not be constructed in the rear yard. Mr. Loiacona indicated that with an existing swimming pool located in the rear yard, a garage would take up too much space. Mr. Penley asked if Mr. Loiacono would be willing to compromise with his encroachment request. Mr. Loiacona responded, yes. Mr. Penley commented that he has a serious problem with a 5 foot encroachment. Page 2 Mr. Schumm pointed out that two vehicles can be parked in the existing driveway with one in the garage. Mr. Schumm then asked Mr. Loiacona to identify his hardship. Mr. Loiacona stated that having spent $30, 000 on each vehicle, he would like to maintain them in his garage. Mr. Loiacona also indicated that he has jet skis and other needs for storage. Mr. Schumm asked if drainage would effect his neighbor. Mr. Loiacona stated that his downspouts would direct drainage to the driveway and :street. Mr. Walz asked if the garage could be moved further back to reduce the side yard encroachment. Mr. Loiacona responded, possibly. Mr. Kaplan asked if Mr. Loiacona has spoken with his neighbor regarding the proposal . Mr. Loiacona responded, no. Mr. Kaplan commented that he would probably not vote in favor of the request. Mrs. Wayne McNamara of 941 Richmond Court was present and addressed the board by expressing her displeasure of not being approached by her neighbor to discuss the request. At 7:35, Mr. Penley motioned to deny the variance request. Mr. Kaplan seconded the motion. A vote took place which was unanimously in favor of denying the variance. Further discussion ensued regarding possible alternatives. With the approval of Mr. Loiacona, Mr. Phillips announced the meeting would be continued to Wednesday, November 8"' at 8:30 p.m. Mr. Loiacona was advised to speak with his architect regarding possible alternatives. The meeting was adjourned at 7:35 P.M.
