Zoning Variation: Docket #01-5 - 241 BANBURY AVENUE
Acting Chairman Paul Kaplan called the meeting to order at 7: 30
P.M. and summarized the legal notice for the hearing. Mr. Jack
Kitten was sworn in and asked to state his case.
Mr. Kitten explained that the proposed fireplace would have an
exterior chimney cantilevered off the side of the house, and that
the chimney would have extericr siding matching that of the house.
Mr. Childers asked if the fireplace would be installed with fire
proof materials required by the Village. Mr. Kitten, responded
yes.
Mr. Schumm asked if the existing gas meter would need to be
relocated. Mr. Kitten responded, no. Mr. Schumm asked if any
neighbors have complained about the proposal . Mr. Kitten responded,
no.
Mr. Walz asked if construction had commenced. Mr. Kitten explained
that his contractor has replaced windows on the house and has begun
installing exterior siding, but has not performed any work
associated with the fireplace.
At 7:38, Mr. Schumm motioned to approve the proposed fireplace,
which was seconded by Mr. Childers. A vote was taken which was
unanimously in favor of approving the variance request .

The petitioner was advised to contact the Village Clerk's office to
confirm that he would be on the next Village Board agenda. The
meeting was adjourned at 7:40 P.M.
