Chairman Phillips called the meeting to order at 7:00 P.M. and summarized the legal notice
for the hearing. Mr. John Durante was sworn in and asked to state his case.
Mr. Durante explained that the proposed fireplace would have an exterior chimney
cantilevered off the side of the house, and that the chimney would have exterior siding
matching that of the house. Mr. Durante indicated that the fireplace could not be located
at the rear of the house because an existing window well is in the way.
Mr. Schumm asked if any neighbors have complained about the proposal. Mr. Durante
responded, no.
Mr. Childers asked if the fireplace would be installed with fire proof materials required by
the Village. Mr. Durante, responded yes.
Mr. Walz asked if the fireplace would have a foundation. Mr. Durante indicated the fireplace
would be cantilevered 18 inches above grade and would not have a foundation.
Mr. Penley commented that he feels the request is reasonable.
Mr. Oliveto asked how far the sidewalk is from the house. Mr. Durante indicated the
sidewalk is approximately 20 inches from the side of the house.

Mr. Phillips asked if the chimney termination would be high enough above the neighbors
house. Mr. Durante responded, yes. Mr. Zaucha added that as long as the chimney
termination is at least 10 feet from the property line, the height would not be an issue.
At 7:07, Mr. Penley moved to approve the proposed fireplace, which was seconded by Mr.
Oliveto. A vote was taken which was unanimously in favor of approving the variance
request.
The petitioner was advised to contact the Village Clerk's office to confirm that he would be
on the next Village Board agenda. The meeting was adjourned at 7:09 P.M.
