Kreutzer T. Rodgers R. Penley J. Oliveto J. Franke T. Walz G. Schumm D. Childress Staff: J. Zaucha, Plan Reviewer Zoning Variation: Docket#01-24 601 DOGWOOD TRAIL Chairman, Paul Kaplan called the meeting to order at 7:00 P.M. and summarized the legal notice for the hearing. The petitioner's son, Mr. Dan Miloch was sworn in and asked to state his case. Mr. Miloch explained that his mother's property has an extremely small rear yard. Mr. Miloch also indicated that he does not believe the deck would be an eye-sore. Mr. Miloch was asked several questions by Zoning Board members,which included discussion of a possible compromise. Zoning Board members suggested it would be necessary to provide sufficient clearance between the deck and fence, to allow for periodic maintenance. At 7:25, a motion was made by Mr. Rodgers to grant an amended variance request. The amended variance request would permit construction of a proposed deck, with a maximum side yard encroachment of two feet (2'-0"). The motion was seconded by Mr. Penley. A vote was taken which was unanimously in favor of approving the amended variance request. The petitioner was advised that she would be notified by the Village Clerk's office, of when the docket would be scheduled on the Village Board agenda. The meeting was adjourned at 7:27 P.M.
