Penley T. Rodgers G. Schumm Staff. S. Trudan, Asst. Dir, Community Development Zoning Variation- Docket# 02-6- 627 Meadow Court Chairman Kaplan called the meeting to order at 7:00 P.M. and read the legal notice. The petitioners, Mr. & Ms. Szponer were sworn in and asked to present their case. Mr. Szponer explained that their house was oriented with the rear yard adjacent to Arlington Heights Road and was located near the intersection of Meadow Court and Arlington Heights Road where several traffic accidents have occurred over a short period of time. He explained that an accident recently occurred resulting in two vehicles ending up in his back yard. He stated that they were seeking a variation to construct a fence for privacy, safety and also to keep children from cutting through the yard. Mr. Penley asked if the petitioner had consulted the neighbor to the north regarding this petition. Mr. Szponer said he had not. The Board asked the petitioner to indicate the exact proposed location for the fence. Mr. Trudan explained that he and the Director of Engineering and Community Development had visited the site, and proceeded to describe the proposed location by identifying easily discernable landmarks on the site. He explained that a fence located between the end of the fence located on the lot south of the petitioner's property, running to a point on the north property line of the petitioner's property approximately 5 feet east of the west property line, would be an acceptable location which would not cause any obstruction to vision problems for the neighbor. It was further explained that this location would ensure that utilities structures such as a power pole and a water main access would be located outside the fence with a tree being located inside the fence at the northwest corner of the property. Mr. Kaplan read a letter from Mr. Casper Weber of 606 Arlington Heights Road for the record which inquired about the proposal with respect to location of the fence and easements. Mr. Weber asked if the petitioner would consider locating the fence inside of the tree and the petitioner agreed. A motion was made by Mr. Schumm to grant the variation for the fence at the location described subject to the condition that the Village would specify the exact location of the fence, and that they not the specific variations as needed. The motion was seconded by Mr. Penley and passed by unanimous vote. The,petitioners were advised to contact the Village Clerk to find out when the matter will be considered by the Mayor and Board of Trustees, and were directed to attend the Village Board meeting. The meeting was adjourned at 7:25 P.M.
