Zoning Variation— Docket# 02-11 — 1703 Westerfield
Chairman Kaplan called the meeting to order at 7:30 P.M. and read the legal
notice. The petitioner, Mr. David Hoffman was sworn in and asked to present his
case.
Mr. Hoffman explained that the reason he sought a variation was because his
architect told him that adding onto the side of the house would be the cheapest
and most economical way to construct the addition. He noted that the land next
to his house was vacant.
Mr. Schumm asked if there would be any conflicts with utilities located in the
easement. Mr. Hoffman said there would not be any problems as there were no
utilities located in the easement.
Mr. Walz asked the petitioner to identify a hardship and asked why the addition
could not be built onto the back of the house. Mr. Hoffman explained that the
project would be more costly to add onto the rear of the house.
Mr. Franke asked if the addition would present any concerns for the Village with
respect to drainage. Mr. Trudan explained that the Department of Engineering
would evaluate the situation as part of the procedure to obtain permission to
encroach into the easement.
Mr. Penley stated that he had a problem with a permanent structure being
constructed in an easement and asked for more details describing the addition
and the existing fence. Mr. Hoffman explained that the addition would be a two
story addition with a basement and added that his fence was located
approximately two feet inside his lot line.
Mr. Childress asked if any of the existing basement windows would be covered.
Mr. Hoffman explained that affected windows would be moved to the west.
Mr. Franke asked if the fence could be located closer to the side lot line to open
up the side yard once the project is completed. Mr. Hoffman stated that he would
move the fence to the lot line.
Mr. Kaplan asked the petitioner to once again define his hardship. Mr. Hoffman
explained that the hardship was strictly monetary.
A motion was made by Mr. Schumm to grant the variation which was seconded
by Mr. Franke. The motion was passed by a 5 to 1 vote.
The petitioners were advised to contact the Village Clerk to find out when the
matter will be considered by the Mayor and Board of Trustees, and were directed
to attend the Village Board meeting.
The meeting was adjourned at 7:50 P.M.
